Dennard hearing today

How would they even enforce that? Have some guy follow him about with a breathilzer?

He was facing a pretty serious 5+ yr felony charge and actually received a slap on the wrist with his initial sentence. Justice was properly served and everyone was more than happy. If you remember his defense atty asked the judge if she'd consider removing the 30 day jail sentence should his client complete the probation with no problems, and her response was that she'd be more than willing to re-consider the 30 days in jail when they met up again in the spring of 2014. Dennard was getting away with a love tap.

He then went out and broke the law on a charge that many people see as a controversial kind of offense; thus breaking his love tap probation.

With her only adding an additional 30 days to make it 60 (he'll serve 38 on good behavior) he once again got a pretty decent shake of things.

His delayed sentence is another break. If this were most people, he'd already be wearing state-issued clothing.

The NFL is reviewing Alfonzo Dennard's legal situation, but there is no timetable for a ruling, according to a league spokesman.


In other words, "We're trying to find out what's the stiffest punishment we can give him"

Yes, another high paying job just opened up!

It means that if he's seen ingesting alcohol, or even possibly around alcohol he could in theory have his probation revoked. It's not the kind of thing that is often worried about or acted upon, but the judge wanted to make sure that it was noted. If he ends up getting into trouble with alcohol again, it's grounds for an orange jumpsuit.

In other words--"no more indo, gin and juice."

I believe the rumor is that he's in a relationship out there, as his girlfriend lives in Lincoln.

60 days in the clink, two years probation with no booze, and 200 hours community service. Tough sentence.

It's never a good idea to get into a drunken brawl with four police officers and then violate your probation in the same city with a DUI.

Are there any lawyers out there who think he'll serve all 60 days, or if he's a model prisoner that he'll get some time shaved off?

At least he won't miss any games.

It's never a good idea to get into a drunken brawl with four police officers and then violate your probation in the same city with a DUI.

Are there any lawyers out there who think he'll serve all 60 days, or if he's a model prisoner that he'll get some time shaved off?

At least he won't miss any games.
Normally he'd be looking at serving 50-60% of that sentence in real jail time. However nothing in this case has been handled normally right from the start. The Lincoln police department has got a hard on for Denard big time and what would have normally been handled as a misdemeanor drunk and disorderly for the original fight became a pissing contest between the cop he swung, his police buddies, and Dennard. Unless I have been misinformed, he had no previous record. And if that's the case the DA going after a felony charge based on the evidence that was published smacks of over prosecution to start with

Clearly the cops have won and if Dennard ever steps inside the city limits of Lincoln Nebraska he SHOULD be thrown in jail for gross stupidity. BTW - at some point in time down the road, if I were Dennard, I look into the possibility of a civil suit against the police for the way they handled this entire affair. Basically that have almost ruined this kid's life over something that happens every single weekend in that college town.
 
Love this country...if you have the $$...you are so much better off in the legal system. But most countries are like that

If you get arrested on a violation, you are presumed incapable of conforming to release conditions. The recommendations on terms of imprisonment for technical violations start at 2 to 8 months.

I would consider his result a very fortunate one. And he had better hear what this judge is saying, or the Pats will be down a decent CB.

There are many states where violation of probation charges cannot be bonded out, and you are promptly placed behind bars until one of two things occurs:

1. The resolution of the "new" charge

2. Your violation of probation hearing is heard and punishment is doled out. Unfortunately for the violator, this can often be a 2 part process, which takes even more time

Here in Pittsburgh in the state of PA, I have seen a ton of probation violations who are only misdemeanors immediately picked up and placed behind bars when they have a new charge. Sometimes they are placed on a high bond until the proper paperwork from the judge/supervising probation officer can be filled out; thus keeping them in jail on what is called a detainer with no bond available.

Other times the violator is sent home and the probation officer just picks them up off the street several days or weeks later from the date of the new offense.

I'd definitely have to say that Dennard is relatively lucky for multiple reasons.

That's not always true, my cousin received a 2 1/2 year sentence in November of 2006 and didn't have to surrender himself until the 2nd of January 2007. His lawyer made his being home for the holidays part of the plea agreement.

I'm sure if we knew how much Dennard has dolled out in legal fees for this "break" it would lose some of its luster.

Fair enough, like I said I'm sure Dennard has paid dearly for this both in money lost by his draft stock and now to fight these cases over the years. The 60 days will just reinforce that.

I think the comparison was made for the "average" person like you or me.

When you're involved in a higher profile case with little or no chance of being a flight risk, these kinds of special treatments are viewed as more reasonable.

As you said, the amount of money that he's dished out in legal fees doesn't hurt either, but I would think that it was viewed as more of a professional courtesy due to his specific line of work, and the thought that it could very well have potentially ruined his entire career.

I am not an attorney, but he will serve 38 days of the 60 day sentence if there are no problems posed by him.

There is something called "good time" that judges use which shaves off a specific number of days per month. It is an incentive that is not difficult to achieve. As long as you don't get into any prison fights or issues that bring major attention to you, the good time incentive knocks time off of your sentence.

I read today that the good time would allow him to only serve 38 of the 60 day sentence, so he'd really be looking at a lot closer to a month than 2 months.

Edit: Here is a quote from the Lincoln Journal Star, stating the same:

The judge could have immediately ordered Dennard to immediately start serving his 60-day sentence (which could be reduced to 38 days with good behavior). Instead, she delayed it until March 31, 2014, which should have minimal impact on his football career.
 
besides the good time , there's also the possibility that the judge will cut the sentence back to a month after he's served 19 days and he walks after 20 days served. Don't snicker. I've seen it happen like that many times.

One of the more unfortunate events in this whole matter is that it sounded like the judge was more than willing to suspend the sentence entirely, should he stay clean and trouble free when the spring of 2014 approached.

I remember his defense attorney asking her and her response was that she would most certainly take that into consideration. Sadly for him it didn't work out that way though. Either way you look at it, the situation shouldn't affect his pro football career unless he gets into additional trouble.

He should be able to report after Easter and by out in time for voluntary sessions/OTA's. That and the fact that he didn't have to miss any time during this season (as of yet) are definitely great signs from a fan's perspective. Of course I think his odds are slim to play on Sunday though, but that's another matter.
 
If he shuts down Eric Decker the next time around they should just call it good.
