The Manhattan Federal Court and the Judge assigned to the NFL suit are not know for being pro big business and conservative. The NFL preferred Manhattan to MN, but it isn't like they filed in a court that is clearly biased to their plight.

the judge is a clinton appointee (and hopefully pro labor).

I'm not surprised.... not because I know law or anything. Its just that I'm starting to believe the NFL* outmaneuvers Brady and the Pats with everything. Every time it looks like there's hope it gets squashed and the NFL* comes out the winner. I'm not giving up all hope but we need a Butler type legal interception to use an analogy...but the refs keep throwing a flag every time we think we made a positive play.

SDNY is not an especially bad forum or jurisdiction. Like anywhere else, there are some excellent judges there, and some not-so good ones. I have not practiced before Judge Berman before, but I understand that he is a respected judge.

That's good to hear. The NFL has had influence on the SDNY before. When the SDNY froze online poker accounts the NFL was very involved because the NFL didn't want online gambling to continue growing. This was likely so that the NFL could help set up more "official" avenues of online gambling that it could profit from in terms of branding/licensing.

I guess it's the SDNY attorneys that I have a bigger issue with than SDNY judges.

No one knows really.

Some of the most awful decisions have come out of that court this year. The court sided with the vulture funds over Argentina on debt even though Argentina already had deals to pay back creditors in collective action clauses, yet the court gave primary rights to late-comer vulture funds. The judge even admitted he was ill-equipped to examine the intricacies of radical banking laws.

I am fine with it. It is all about the kind of judge you get. It looks like they are getting a liberal judge that is pro union. I don't believe a federal judge even if he turns out to be a NY sports fan would let that influence him.

Something tells me this judge knows the NFL business pretty well.

Well, if that is the case, the NFLPA will file to have him recused for conflicts of interest.

Yeah I've tried to be positive through this whole thing, but I just have a sinking feeling that this is going to get crapped on by this (or any) NY judge. And I am sure the PA will appeal again after that, but the idea of Week 1 without Brady is getting realer as the seconds tick by.

There will be no injunction if they file for an appeal and the case is not taken but dismissed by the court.

I'm wondering about that as well. I've never appeared in a MA federal court but I've heard bad things.

How bad could it be? There no way it could be worse than a NY venue in this case, could it?
