of The MMQB and ESPN, Brady and the NFL Players' Association can appeal to the full Second Circuit (en banc) and then to the U.S. Supreme Court.

Note: En banc means all the judges of the court would hear the case, not just a panel of selected judges.

There are several layers here," Wallach said. "The first stage is over the course of the next few weeks, Brady and the Players' Association will file a petition with the court and ask the court to rehear it. The court may then ask the National Football League to file a response. "If you have two different federal appellate courts viewing the role of an arbitrator under the NFL CBA differently, you have a split among the circuit courts, and circuit splits are the No. 1 reason why the U.S. Supreme Court takes a case," Wallach said on 98.5. "Ninety percent of the Supreme Court dockets are because of circuit courts, and trying to achieve uniformity in the federal law."

Tom needs to decide what is best for him or the team. For him, it's to keep fighting. For the team, it's to take the hit early in the season (as opposed to later) and be pissed off the rest of the year and win the SB.

I think at some point the integrity of the game needs to come first. Never ever let the NFL win. I'm pretty heated about this right now but, I'd forfeit all four games. Giving the NFL the middle finger opening night in Glendale in primetime would be priceless.

Sorry mr Kraft Brady does not agree with your belief that quitting is the best way to go.

Totally agree about the payoff for us; not sure there's much likelihood or that it pays off well for the other 52 guys.

no clue what that means but my points stands. Kraft quit Brady will not.
 
The kneejerk reactions are understandable. But the forfeit talk is absurd.

I expect a firm and sensible response from the organization not something as mind blowingly stupid as a stunt like that.

Unless you don't mind Goodell using the powers confirmed in court to suspend Belichick for life and take away our entire draft for the rest of the decade. Think he can't do that? Think again. The court said he can call whatever he wants conduct detrimental and punish any way he sees fit.

I'm leaning that way too. Last thing I want is Tom to quit. With that said i would understand if he put down the gun. Toms a team first guy but clearly this situation will be a story during the season if he fights it.

At this point I'd be OK if the Pats forfit the first 4 games. I'm so pissed off right now at this ******** NFL imperialism that if be fine with the NFL and Bob getting screwed out of money for what the did to Tom.

Screw it.
