This thread should be merged with the megamonsterthread. It's only appropriate.

yeah, why was that moved to the other forum? So we could start a new thread here?!?!?

I also like Brady liking everything Brown posts on Instagram almost immediately. It's his only way of protesting and showing he disagrees with the personnel decision. I don't see him "liking" Myers or Gunner's posts.

It appears Brown has a very strong chance of recouping the $9m from the Pats.

Antonio Brown's case for recouping $40 million: Could he really win his grievances?

This would be ridiculous if Krafty Bob ends up paying Brown $9m for 1 game. We should settle the grievance with him and in the process bring him back.

Of course Brown will get the money. Kraft couldn’t wait a week to see if Brown would. be placed on the Exempt List. Brown was released before there was any ruling that he was unavailable to fulfill his contract. The Raiders covered their bases and terminated Brown with clear cause to do so. The Patriots chose to place Brown in a permanent limbo that is best for the league, at their own big expense. That’s Bob. It goes against precedent and the basic tenets of fairness to not allow an accused player/employee to even present his case to the league before terminating him like that. And anyone who tries to hang it on those texts is out of their mind...again, there was no criminal charge or league investigation/ruling that those texts would preclude him from playing. Bob got played. The sun came out today.

I hope Kraft has to personally write a check to Brown and AB puts the photo of the check on Instagram. Different strokes for different folks.

I don't see your logic here. I mean Kraft (and most probably the organizational lawyer) considered those messages together with the civil suit story enough to void those guarantees.

Now he could have been wrong but why would he need to wait for a ruling ?

There’s a process built into the league and CBA. It’s a collectively bargained for agreement that a player is entitled to an investigation/ruling by the league and can’t just be suspended for an accusation. In addition, a team cannot simply assume a player will be put on the exempt list and be unavailable until it actually happens. The kangaroo court must take place before a team can posit that the player has made himself unavailable for service.

So that’s the boilerplate guarantee void in the contracts. It’s possible the Patriots included other offset language. One clause teams use is that any team suspension voids the guarantees. But there was no suspension.

Others may have a clause that criminal activity voids a guarantee, but neither the texts or the lawsuit have drawn criminal charges.

As I said, it would be unprecedented to release a player and void a guarantee in the absence of anything that has the potential to void guarantees. Saying you think a player is “a pain in the ass and a distraction” is not enough. Brown broke no laws, wasn’t suspended by the team, and wasn’t placed under any sanction by the league. This is why the article referenced states he has a very good chance of winning this grievance.

This could have been remedied by merely waiting a day or two until the NFL placed Brown on the exempt list. The Patriots could have suspended him indefinitely as well. Kraft made an illogical decision, so I wouldn’t be so sure he was going on his attorney’s advice. He made a knee jerk call.

I don't care enough about all of this to go in too deep because AB won't be back, Kraft did what he thought was the best for him and we all have to move on.

But the language in ABs contract was absurdly broad. That will be the key in the entire 9M saga and not what the CBA says about investigations or what happened in the past.

You can have a prolonged legal fight over the question whether his secret negotiations with his accuser and not letting the Pats know in broad terms that there is a pending civil case already constitute enough to be considered "bad faith".

But whatever.. who cares the AB chapter is over and you are all beating a dead horse.

With a whole bunch of teams bidding for Brown and knowing his behavior, do you really think Rosenhaus didn’t require an airtight contract from the Patriots? I guess we won’t know until later on, or maybe not at all. But I highly doubt Rosenhaus would allow much wiggle room considering all the other teams offering deals. The Patriots were not exactly in the driver’s seat when Brown signed the contract. At one year, a very good deal for the Patriots, this screams of an “all sales final” agreement.

The CBA trumps any clause in any contract that the Patriots could come up with so yeah, the language of the CBA is pretty important.

This is an excellent point. Problem is they didn't cut him when all that came out so that fact weakens their case.

You don't care that the Pats lost $9m in cap space?

AJ Green would basically be a less drama filled version of AB. Theyre basically the same age and Green is bigger. Bill made it happen with Corey Dillon and he could do it with Green but I'm not sure if Cincy would do it.

The link I posted was a legal opinion that a pending civil suit does not need be disclosed since there's no history of a civil suit ever eliciting a response from the NFL. In addition even after they found out about the civil suit, they kept him on the roster and played him in week 2. Pats have no case to stand on. They are only left with some SI story and some stupid texts which are even more meaningless. This is why the Pats will likely have to cough up the $9m.

Not really. There is nothing I or anyone can do about it and circlejerking about how useful AB would be or how hypocritical Kraft is will not change anything at all.

He has been released, we will either get the money back or not and that is that. At some point you gotta move on.

I literally don't give a ****. Then they will have to pay 9m. They took a shot and it didn't work out. Whatever.

Exactly. They can't use the civil suit excuse. All they have are some texts......... boo frickin hoo.

Why do you keep coming back to this AB thread then? Don't click on it. You clearly don't want to participate in the discussion.

He could have come back had he not bashed Kraft on twitter

You're right. It's totally possible to have a world-class defense, an awesome QB, good running game, and just JAGs like Reche Caldwell and Jabar Gaffney for WR and win the Superbowl.

oh wait..........

Oh and btw, the team that beat us that year had Marvin Harrison and Reggie Wayne............... not that it matters.

Perhaps it was before you became a fan, so I'll make it short:

Half the Patriots had the flu that AFCCG. The Colts turned up the heat. Pats had a huge lead at the half and dehydrated the 2nd half. They lost in the last minute on a Brady INT.
The score by the 'offensively challenged Patriots'????? 38-34. The problem that game was the Patriots Defense giving up 32 freaking points in the 2nd Half. Can you understand that last sentence?

AFC Championship - New England Patriots at Indianapolis Colts - January 21st, 2007 | Pro-Football-Reference.com

Brady had a better QBR than Manning that game.

Your point is a FAIL.

The next year they had arguably the greatest offense in NFL history and also lost the SB by a score of 17-14.

Ice up, son. You can take the makeup test. But you're going to have to study real hard. Stuff like this isn't easy for folks like you who weren't actually following the team back then.

We should take off and nuke it from orbit. It's the only way to be sure.

I refuse to say the name anymore. But I will say this: fair or unfair, right or wring, please accept the reality that, getting paid or not, Alpha Bravo is Tango Uniform for 2019.
