lol. Lawyers don’t work for free. Even if they took it on pure contingency they are looking to get paid, and if thats the situation it makes a settlement inevitable because they don’t get paid without it. They are doing plenty of work before it goes to civil trial. I’d bet dollars to donuts the chef doesn’t go in two weeks later to make a police report without being advised to do so by her lawyer. Her lawyer is helping play this for maximum settlement value and that doesn’t start with the civil trial. A lot of the settlement value to the defendant is avoiding that trial so there’s a lot of value lost if it goes to trial.

Think through what a civil trial would have at stake. What are the damages? Lost wages for a couple of months. Pissant. Crumbs. Not worth the effort going into this. There’s no evidence of physical harm, no visible injuries, no ambulance run, no ER or doctor visit. No monetary damages for physical injury. Maybe emotional damages, but it’s not like she was in any relationship other than employee:employer, so there isn’t any emotional bond to speak of. About the only basis she could assert would be PTSD after fearing for her life, but she’ll have to convince a jury it was really that violent, in the absence of physical injury, instead of just being a shakedown for more money. It’s not going to be an easy win for a lucrative payday. If the shyster is on pure contingency they’ll want to settle before it goes to trial.

Read the report again.

He told her to leave for Thanksgiving because he had people over.

Incorrect. She was told to leave from 11/7 - 11/14.

She stayed at a friends.

She came back at some point either on or prior to Dec. 2.

Correct.

At that point they had a dispute over text about her pay.

The dispute about the pay was for the week of 11/7-11/14. When she was forced to vacate the room. Something that supposedly wasn't stipulated in whatever contract she signed.

He fired her during the text dispute. Look at the timeline of the texts.

The text on TMZ seems to show she was fired BEFORE the text dispute.

When he confronted her during that text dispute, he went right to her room.

The room in his house that, if she'd already been fired, she shouldn't have been in.

He knew exactly where she was. If he didn't know she was in the house when he was texting her, why in the world would he go to her room to confront her?

If I don't know where someone is, I might go look for them in the place they'd been staying. That's a pretty simple thing. You're acting like it's something damning when it's not.

Under no definition would she be considered an intruder. The texts are pretty clear.

You're wrong. She would be considered an intruder if she'd already been fired. She claimed in the police report that she QUIT after the altercation. So there IS a discrepancy you can't account for.

There is conflicting information on that. She is claiming she QUIT on the 2nd according to the police report. It also seems like she quit AFTER the altercation.

There is a claim that she was fired PRIOR to the 2nd, possibly prior to Thanksgiving, but that hasn't been confirmed as of yet.

Well, I'm not reading 25 pages of these rants, but from what I heard from the Radio on the way home, I am no longer worried about it as far as the Pats are concerned. (and that's ALL I care about. )

Much ado about nothing IMHIO. I have some familiarity with law enforcement, and 3 major points. (and sorry if they have been discussed)

1 This report is just a cop filling in a form concerning a charge by a member of the public. He is essentially taking down ONE sides point of view 2 week after the event.


2. There are 2 reasons why Diggs ATTY didn't want the report public other than the obvious one of bad PR. One is that ilt gives to the public his phone# and address, which is bad form by the police at this stage for any public figure. That shouldn't have been done and Diggs might have grounds for a suit against the police. At this point all he is is a name on a police form. 2nd is the details itself. That should have only come out when the police had determined that they had enough evidence to a prove a crime had been committed. THEN release the details of the accusation

Otherwise I could say I saw someone here diddling a 10 year old girl. Give all kind of gory details and have the police publish your address
/phone#, everything I accused him of, and watch him struggle back to get his life back before ANY evidence is produced. THAT is why the police don't normally go public with the accusation report. Cop must have been the son of one of those leftover Giants fans from the 60's

This part here is where Diggs needs to wise up on how to conduct such business. You don’t go confront such an individual, at some point you should understand who stands to lose a lot. New money folks can be very ignorant about wealth preservation.

I think you're misunderstanding what I'm saying.

I'm saying the lawyer doesn't have to devote time to this until there's a civil trial. Whatever agreements they've made, the smart thing for them is for the criminal case to proceed. If it were otherwise, this thing would have already been settled.

You don't have to have absolute proof. All you need is to convince the jury that what the Diggs people perceive as "no big deal" was a violent chokehold, and a very big deal. "No big deal" references the fact that she was going to the police about something and that"it was no big deal." If a DA can convince a jury that the words are an acknowledgement that something happened that could be potentially reported to the police, he could lose. Why is a DA taking this case on? If Diggs had yelled harsh words at her, the text would have read, "Go ahead, go tell the police I yelled at you in my own home!!!!!!"

You act like this woman is somehow suspect in all this when we know AB is crazier than a loon and that her version of the story is 99.9999999999999999999999999999% (to quote Ali G) believable, especially in retrospect.
