Disagree. The issue before Judge Berman was Section 10 of the Federal Arbitration Act, 9 U.S.C. § 10.

(a)In any of the following cases the United States court in and for the district wherein the award was made may make an order vacating the award upon the application of any party to the arbitration—
(1)
where the award was procured by corruption, fraud, or undue means;
(2)
where there was evident partiality or corruption in the arbitrators, or either of them;
(3)
where the arbitrators were guilty of misconduct in refusing to postpone the hearing, upon sufficient cause shown, or in refusing to hear evidence pertinent and material to the controversy; or of any other misbehavior by which the rights of any party have been prejudiced; or
(4)
where the arbitrators exceeded their powers, or so imperfectly executed them that a mutual, final, and definite award upon the subject matter submitted was not made.

Judge Bermans original ruling, which I agreed with, was overturned on an appellate level by the 2nd circuit. The majority opinion, which I also disagree with, stated herr goodell acted within his scope of powers, and acted within established labor law in doing so. At that point, there was no chance the soctus was going to hear the case.

In my opinion - There is no question Brady and the Patriots got screwed. There is no question the arbitration in this case was unfair and partial. But I also understand that life is unfair.

However, whats hardly mentioned is deflategate stopped being about the actual deflation of footballs and morphed into the argument that goodell had the right and authority to suspend brady, or anyone else for that matter, regardless of fact or circumstance... we all know it after the wells report was released... anyone with half a brain and one ounce of skepticism knew that that report was written backwards...

and thats why the Patriots lost against a stacked deck. Its why, no matter how much b?tching about Kraft there is, there is zero he could have done to protect his team or quarterback. he saw the writing on the wall early on. He got played the fool though. He thought that there would be exoneration thru the science. But that would only come if the league wasn't playing games, which they were. They were gunning for Belichick, and wound up netting brady and a couple clowns.

it did expose the petty rivalries that make up the NFL ownership group. its a pretty pathetic group of billionaires.
Kraft could have gone down fighting, but instead he folded and decided to support the status quo. Can you imaging Al Davis doing the same?
 
So Matthew Stafford made a joke about deflation when he and Burrow were being interviewed by Rich Eisen yesterday, and Rich Eisen said "Matt we're being told no deflation discussion, that is off the table" while making a throat cutting motion
from the producer in his ear

They are fed a narrative and told to push it, or not push it, whether its BS or not

IMO, Goodell warned Kraft what would happen to the Pats if Kraft did just that.
 
My own take (from having read pretty much everything on the topic, including new Seth Wickersham book), is that the Patriots, including Brady and Kraft, weren't certain what Jastremski may or may not have done in the bathroom. We know that Brady liked the balls on the low side, and so it is quite plausible Jastremski routinely let out a bit of pressure before games. They still might well have been within regulation pressure before the ideal gas law did its thing though.

Note well where the ref says clearly, "12.5 - close enough". Also note that little air pump. Those things work with a fast-moving piston to pump the air. That piston gets hot and the air they pump also gets hot - above room temp. This also adds to the uncertainty of that intial air pressure. I once had to use one of these in our test lab and I put it into a large vented box because it made a lot of noise. The pump died in less than an hour because it overheated. When I opened that box to see why it stopped working, it was almost on fire. That pump is not adding room temp air.

Jastremski set the pressure to ROUGHLY 12.5, which is the lowest number in the NFL's acceptable range. The referees ROUGHLY confirmed this.

Exponent's report was supposedly written by scientists. Any scientist with a degree who accepted those initial numbers as absolute is not a scientist. Exponent's report should have come out in a matter of hours after they received the "data" with a single line in it that said, "Due to an unknown initial air pressure, we could not determine if these footballs were tampered with."

On a side note: I have a theory that Jastremski actually randomly tested 3-4 balls with a pressure gauge while in that bathroom for 98 seconds...just to be sure they weren't dramatically over inflated...which could have attributed to about an extra .01-.02 drop in pressure.

Except that it was McNally who went to the bathroom for 98 seconds on his way to the field and was being accused of deflating footballs. McNally - the "ballboy" who had nothing to do with the game ball preparation. That was Jastremski's job.

I am only disagreeing about the part you said the larger arbitration issue wasn't on appeal. The case never got to Justice Ginsburg for an emergency stay of the lower court order because Brady just gave up. I think he should have just tried. Maybe he was tired and wanted to move on with life - who knows. He won in the end because he added 4 rings since the event, but a victory over Godell in court would have been nice.

Al Davis is not an owner you should ever aspire to emulate for his last few decades and it’s intellectually dishonest to not recognize that the NFL in 2015 was an immeasurably larger power house than it was when Al Davis took it on.

He said in his doc 'Man in the Arena' essentially that he got tired of the fighting so you are spot on.

This stopped being about an equipment infraction and all about Goondell's ability to do whatever the F^ck he wanted. There was no way the NFL was giving up on this fight. Hell, even if it made it to the SC, they probably would've taken out one of the justices if they felt the vote was against them. The NFL is the 7th family of the Cosa Nostra.

The unfairness of the situation was noted by Berman. If anything, Brady won a moral victory. Lost on a technicality. As soon as the appellate court stated goodells actions were with in standard labor practices, there was no longer a case. SCOTUS is very selective of the cases it hears. Highly doubtful this would have made their docket. Like dumb and dumbers "so I got a chance" chance.

Fighting what? There was nothing for him to fight. The other owners literally put him on Viques Island and were slinging live ammo at him. It is my opinion that Kraft was told by goodell that his ownership of the team was imperiled if he brought suit.

He started out very vociferous 8n his denials, sabre rattling and the like. Then all of a sudden he shuts up? Another scenario doesn't make sense ... To me at any rate...

So Kraft did what he could to refute the allegations with his little website... And that was it... Somebody stepped on his toes and laid it out for him... Letting him know where things were headed if he kept it up...

The National Football League reportedly created a new Chairmen's Committee this week that features five owners, who lead some of the league's most high-profile committees.

Mark Maske of the Washington Post reported the group—which had already been informally meeting with commissioner Roger Goodell—includes Robert Kraft (New England Patriots), Art Rooney II (Pittsburgh Steelers), John Mara (New York Giants), Clark Hunt (Kansas City Chiefs) and Robert McNair (Houston Texans).

The new committee isn't currently expected to take any official votes on issues facing the league. Instead, the owners being directly connected is supposed to streamline the process when it comes to "identifying the NFL's top priorities and helping to ensure key issues are coordinated among the committees," according to the report.

Although Kraft is a longtime friend of Goodell, his inclusion could come as a surprise given their public disagreement involving the Deflategate drama.

Gregg Rosenthal of the NFL.com noted in March that the Patriots' owner sent a letter to the commissioner asking him to reconsider his punishment of quarterback Tom Brady.

Ultimately, including Kraft in the group of high-ranking advisers may be Goodell's effort to extend an olive branch to the Patriots' owner. His input is valuable after spending more than two decades as the leader of one of the league's most successful organizations.

Kraft and the other four owners selected represent a formidable group of key members in the NFL hierarchy. It will be interesting to see whether the new committee leads to any meaningful change after a tumultuous couple of years of the commissioner.
 
If he really wants to own a team, in hindsight, taking all those below market contracts probably wasn’t the best idea

He, himself, is close to billionaire status. Never mind the revenue that his wife still gets from all the modeling she did.. She's been the one of the top 5 paid (if not the top paid) models for like 20 years now..
