Higher or lower is always stated for draft purposes as "higher means picks earlier". The NFL* takes the highest one, so that is the Seattle pick currently.
That will probably be the one taken since the NFL* bastages really rigged it against the Pats, to the point that it will prevent the Pats from trading up for a sliding player since that pick would instantly be confiscated.
That clause really shows how loathsome and petty the NFL* leadership is.
Other fans just think the Pats lost a 1st and a 4th, but it was more crippling than that as the NFL* really tied the Pats' hands.
It would really screw us if there's a surprise and the Browns don't get a 3rd round comp for Alex Mack. We're getting that for Collins. Nope. It's over. Thankfully we won yet another SB despite the NFL's best efforts.The big question to me is Will RK or JK start trying to work up some media to troll the nfl /or themselves attack them about giving the pick back, writing articles asking Why not, what evidence did you ever have??

The Pats are prohibited from trading their 4th round pick.
It's not worded the best but it means we can't trade our own #4 to ensure we have one to be stolen. However if we happen to acquire a higher one, that higher one is stolen instead. The terms of the penalty specifically prohibit the Patriots from trading the pick the NFL would confiscate (i.e., they can trade their own 4 right now, but they can't trade Seattle's).

So I can only assume that BB will move that Seattle pick sometime before day 3 of the draft and just let Goodell have the 32nd pick. Plus don't forget the Giants pick gets moved down to the end of the round (so I guess the Pats pick would then be pick #31 of the fourth round).
