My wishful thinking/best case scenario is that he WAS parked off to the side to begin with, trying to sober up with some tunes playing and was close to an intersection. That would technically be the offence. I've had a friend get a DUI for pretty much the same thing.BTW, the DUI is pretty serious..

1- He was at an intersection
2- He was passed out at the wheel
3- The engine was running.
So, it's not like he was on the side of the road somewhere and just trying to sleep it off.
It's hard to imagine pulling up to a stop sign, putting the car in park, and zoning out. If he just passed out, he would have probably stalled the car out (in a manual) or creeped through the intersection (automatic).
Not making excuses for the guy, he has a lot of options to avoid that situation either way, but it was clear he was parked and sleeping at a stop sign...just trying to add up how that happens.
