Ted Olson hmm. Poor guy lost his wife in the plane that went into the Pentagon on 9-11. Does this portend a defamation suit or more procedural tack based on the recent ruling. Either way fat head Goodell is not going to have that stupid Papa Smurf smirk on his face for a while.
 
Olsen carries the same gravitas Clement does in front of the top courts, sounds like they are thinking about the Supreme's. His wife Barbera died in the 9/11 attacks.

Why not. Nothing to lose. I did a quick look up of the 2nd circuit and it seems most of the people are Clinton/Obama appointees. This seems to overall be a case where your ideological perspective comes into play a lot and leftist leaning judges i think are more likely to side against the NFL and with Brady.

In the majority opinion a big reason why they sided with the NFL is they came at it with the idea that if what Roger and the NFL did could EVEN POSSIBLY fit even the broadest bounds of the power the NFL had then it had to be allowed.

Why does it need to be interpreted that way?

I think if this goes to the full 2nd circuit or even the supreme court (and with a case this big and well known and with the implications it has it maybe could) then i think it is possible it will be reversed again.

Except the problem is that Judge Chin was one of those leftist leaning judges. So they've already swayed one to the dark side in this case....

But it still a long shot to get an en banc hearing at the 2nd circuit. Theodore olson should have been brought in earlier. They have to convince 6 other judges for an en banc hearing in a circuit that does not like to touch arbitration results. Just because olson is on board does not mean the court will grant one.
 
While I don't think it impacts their chances of getting an en banc, it certainly indicates to me they will appeal to SCOTUS when the time comes.

Yes! Olson's specialty is with the supreme court.
