As long as Roger Jets Goodell is commish, the NFL is truly ****ed

Goodell is basically an incompetent, untrained pilot on a plane with total engine failure. The crash is happening faster and more spectacularly than it would have under competent stewardship, but it probably would've crashed anyway. Maybe someone that knew wtf they were doing could have salvaged the ****show and saved some lives with a crash landing, but Goodell just steered it directly into the ground.
 
To be fair, this has to do with a whole lot more than sports too. This case is fundamentally about the standards of arbitration in the workplace, which affects a ton of Americans. I don't think you're wrong, in that a whole lot of people would interpret this as being a case about sports, but if the SC cares more about impact than PR, then this could very well be a case worth taking on.

Isnt this about contract law too?

Goodell breached the contract with the NFLPA when he did not follow the protocol as written.
 
How would they know this? They made no effort to look at any QBs in the draft...their draft board will inevitably change now.

With knowing the suspension might happen and lowering Bradys salary for the 1st 4 games.
 
I read that opinion as the Court saying "We don't want to deal with this. Your sloppy CBA has given us an excuse not to and we're taking it. Buh-bye."

A legitimate Court would focus in on the 'appropriate action' that underlies this whole disaster. The CBA has to be interpreted as being valid only if the parties act in good faith. The issue is that Goodell didn't. To me, that makes his 'actions' in-'appropriate' and, thus, outside the CBA.
The chief judge dissents... and the two others are brainless idiots.

Next stop would be Supreme Court via writ of certiorari, but a petition for certiorari seeks Supreme Court review not as a matter of right but as a matter of judicial discretion.

On top of that, they get hundreds of requests every year, and pick and choose just a handful, and this, AFAIK, would be the first sports-related case, and if picked, might cause backlash because there are far more pressing issues for the SC to deal with than something to do with sports.
I think there is one more level before it reaches the SC. I believe i read a few months ago that these three judges are part of a larger group of appellate court judges that could hear the case if one of the parties didn't like the three judge panels ruling.
 
...and the players getting bent over a barrel during the last CBA negotiation continues to haunt them. I really don't think this is going to go to the SC, but I would love to see it. Either way, if the Pats can come out of that opening stretch at 2-2 or better, they should be in okay shape. At least we get to see what Garoppolo can do in real game action with a full compliment of players behind him.

Still excited for the season? The chance to be champions of such a dirty, corrupt league? Just what does it mean anyway? What value is it?

What's Bradys recourse here?

Appeal to the Supreme Court is the only option I think.. they have given Berman no options, they won't let him even rule on the other 3 main issues, like evident partiality, etc.. their decision was to and it back to him to uphold the suspension and that's it

Basically they shat all over a federal judge, I'm sure Berman is pissed about this but can do nothing

In theory they can't afford to be that légère about the matter as they create legal precedence with their ruling. That's so shocking about all of this, if you people could stop looking at this as a sports issue but realizing what consequences this could have for labor law its crazy.

Unfortunately, the whole matter is being trivialized because of the sports angle even though that's a red herring.

If we were the Browns or the Dolphins maybe. Like Ernie said in the Do Your Job documentary we like to be prepared for all situations so Brady losing the appeal -- especially after the debacle that was the hearing -- was definitely a real scenario they would expect and prepare for.

To be fair, there's been a whole string of SCOTUS cases gutting oversight of arbitration cases for the last decade. Not just labor arbitration, but consumer arbitration as well. Arbitrators basically have carte blanche without any court oversight except on procedural grounds, and the CBA cedes binding arbitration to the NFL without any reservation.
 
It's Kraft that needs to be boycotted, he did **** all as an owner but bow down to Goodell. Instead of going to bat for the player that made him the owner he is and turned this Franchise into what it is, belated down.

Boycotting the NFL as pats fans won't nearly do as much as boycotting Kraft due to their being 31 other franchises.

Prepare for a lockout and lost season whenever the CBA will be up. After all that's happened in the last few years I think the next one will take some time.

How sure are we that Berman cant do anything?
This is starting to sound like a personal law suit book and movie.

Also eff the NFL I want Gordon even more now because he may hate the league more than Brady and thats what I want I want bad guys who hit guys when their down cuss when the camera is nearby push refs and ignore their media and uniform requests.
