This may sound silly, but (A) couldn't they have just modified his contract to add incentives rather than cut him and resign him with the incentives? (B) Does modifying an existing contract make it ineligible for the veteran's minimum cap charge?
(A) No. Vet minimum contracts cannot be renegotiated during the season.
(B) Not necessarily. In this case, it does: the limit for additional compensation is $65,000. Cole's incentives max out at $285,000.
So Cole's new contract is no longer eligible for the "Minimum Salary Benefit."
I actually like this (keeping Cole). You never want him to be a regular contributor on D, but if two guys ahead of him get hurt, you could do worse.

I think it was more likely he was cut, and when they asked for his return his agent requested additional $$ and in order to meet the demand the team made the decision to center it around playing time so they wouldn’t have to guarantee it.

What if another team claimed him off waivers? If they viewed Cole as a valuable player, they wouldn't have exposed him the way they did.
(A) Unrestricted FAs do not pass through waivers prior to the trade deadline, so that point is moot.
(B) Vet minimum contracts cannot be renegotiated, period.
I think it is called negotiation or something, the Patriots didn't do this to be nice to M Cole.
