"Judge Berman made it clear today that he won't be taking this case because judges do not want to get involved in arbitration under collective bargaining. But he did make it clear that if he was to hear this case that he feels that the NFL has laid out a solid case that proves Brady orchestrated a scheme to deflate balls in the AFC Championship Game. If I was Kessler, the NFLPA, and Brady; I would settle for that four game suspension because this judge could increase the suspension to eight games."

Stop it, did he really say that? Increasing the suspension isn't even on the table.

Attorney Jeff Kessler admitted Tom Brady could have handled cell phone differently. But said it's "most overblown issue in 40 years of law."

Good. Then I don't have further significant concerns about him accepting the hypothetical that McNally misbehaved in the bathroom.
 
Credit brady for not punching him. I dont know how he can stand seeing them
Brady could have punched him and the settlement could have been 4 games for punching Goodell, no admission of guilt regarding deflation...

There are no good days in DeflateGate. Only bad days, worse days, and days of horror. If the NFL rescinded Brady's suspension, gave back the draft pick, and fired Goddell, the whole thing would still be a nightmare.

Ah, so Kessler didn't abandon the Ideal Gas law. Only conceded it was possible McNally did something. Thanks for the context.
 
HOLD the optimism. What Berman did today was try to get people to think about their positions.
Consider "Are you right or wrong?" he seems to be encouraging. If He can lead the sides to see problems with their position maybe it will help them settle.

The next court date will be about CBA procedure violations. It probably won't matter if the balls were intentionally deflated but only the if Goodell believed they were and will focus on possible CBA procedure violations. That may not go Brady's way.
The hearing today was just to get the sides to think about their position. IMO.

See, I disagree. The fact that Berman called into question the veracity of the Wells report and the lack of evidence against Brady signals that, without a settlement, the NFL is very likely to lose because they'd have no basis for the punishment. And with no basis, everything else was a farce and unwarranted..
 
Goodell really is a stooge. Did he actually think Brady was going to play nicely with him? I bet Brady wanted nothing more than to flip him the bird.
 
Except the question isn't simply a matter of "Were the balls deflated?"

The question is, "Were the balls deflated, and, if so, did Brady have an active hand in causing that to happen?"

Using the first question would be like suspending Matt Ryan because the Falcons pumped in fake noise.

Well, today the judge said the balls were deflated. He wasn't asking. Doesn't mean he believes it. But he did say it.

He also said that it is inexplicable that a QB would not know the ball was deflated.

In other words, he went all Brunell on Tom Brady.
