"Judge Berman made it clear today that he won't be taking this case because judges do not want to get involved in arbitration under collective bargaining. But he did make it clear that if he was to hear this case that he feels that the NFL has laid out a solid case that proves Brady orchestrated a scheme to deflate balls in the AFC Championship Game. If I was Kessler, the NFLPA, and Brady; I would settle for that four game suspension because this judge could increase the suspension to eight games."

It can still go both ways if they don't settle. If the judge is somehow convinced that deflation occurred, he may just punt it and say, that's the NFL's CBA discretion.
In fact, the only thing that might be holding Berman back from giving the NFL carte blanche is the extreme harshness of the punishment. He may feel that's where he has to step in.
If it was a smaller punishment, he might have just kicked them out of the court room.
