Brady's agent's response

If this goes to the highest court I want them to subpoena every locker guy who looks after each teams footballs from the 31 other teams as well as there hand phones, texts etc information taken. I also want to subpoena every starting QB from the 2014 season to get them to say how they have there footballs prepared. I want Tom Brady to take down everyone that stayed silent, that let down Tom Brady, they know they could have stopped all this rubbish. Actually scrap that.. make it 30 other teams.. Kaepernick is OK

This is a great point. Only the Pats got the anal exam, no other teams did. Other teams can sit back and enjoy the proceedings as the Pats get eviscerated since they had no skin in the game.

If there was a completely independent surprise investigation of all NFL teams operations league-wide, a lot of the gloating fans would be starting to worry, and with good reason.

I have always said that watching the NFL is like making sausage. Enjoy the product but don't think about how it is made or you may not like it as much.

I have no illusions that the Pats are squeaky clean, but I also don't think there is any reason to suspect they are any worse than any other teams.

Fortunately for the holier-than-thou teams who are enjoying the destruction of the Pats, they don't need to worry about having all their skeletons exposed for all to see.

On the rare occasions when a skull or femur falls out the the closet, they can rest assured that the Omissioner will be there to stuff it back in the closet and the clean up cost will be minimal, and best of all, no one else has to know.

By what avenue or mechanism? Not being sarcastic, I'm asking if there is an avenue for appeal for a team? From what I read here a team has no recourse. Emperor Goodell's word is absolute when dealing with teams (though AL Davis is rolling in his grave as I write that).

Outside arbitrator. If Brady goes to court and demands one, he'll probably win the case. (That's not the same thing as saying the outside arbitrator will render a decision favorable to him.)

Great response. Has me fired up.

I worry the suspension will be partly upheld for withholding text messages, I certainly don't blame him for that though even if there wasn't anything incriminating on there.

Certainly a concern.

Now I know why Irsay was so calm about this he probably knew this was not an investigation in the first place but glad that Brady and his team are going to fight this

Ray Rice 2 game suspension and Brady 4? I don't think so!

Bring it.

th

Goodell and his posse of thug enablers is about to learn to prime rule in these sorts of games: Stab Last. Stab Deepest.

Federal court cases take time. Without a rush, the Pats won't even get to a neutral arbitrator before the season starts. Further, even if they got to one in August or earlier, the distraction and uncertainty could be pretty bad. Time is indeed of the essence.
they can quickly get an injunction against the league which will prohibit them from imposing any punishment until the appeal is settled.

That's why the first step is to sue for an INJUNCTION against the NFL's actions. And the second step is to go for the Appeal. Or file BOTH at the same time. Don't allow the NFL to moot the case by dragging out the appeal process.

Agreed.

But it's even cleaner to get the league to agree rather than to get one with the league arguing against it in court.

Word. I fully expect the lawyers to be doing this as we speak.

Agreed. But TB needs to do what he needs to do and if Goodell won't cooperate.......

Getting and winning an injunction is possible-especially when the report exonerated the chairman/officer (Bob) and operating executive (BB) as not having fault.

I hope your right and they do.

Great statement. Unfortunately the mission has already been accomplished by Goodell. Pats lose picks which is something they can never get back.

Even if an arbitrator says Goodell is a incompetent was out to get the patriots and this Wells report was a complete hack job that that has no basis Goodell still comes out looking like the savior of the NFL.

Tom Brady can sue, but his 1st move will be to file an internal appeal. Don't expect any lawsuit until after the appeals process plays out.

Mcann thinks otherwise.

Giselle can hire a whole bunch of WORLD CLASS litigators for a half BILLION dollars. Have fun, Rog...."bend over and say ahh, Mr. Ommisioner...this won't hurt TOO much..."

Yee will anything relating to the investigation of the footballs. The main thing NFL is going to contest is the lack of cooperation according to them. That is what yee has to prove somehow is wrong.

He has to file a grievance first and go through the process before filing a lawsuit. At least that's what I remember from labor law.

I actually had McCann in law school. He's a great guy.
