The way I see it you have 2 choices.
  1. You can trust the word(s) of the NFL , who has a history of questionable ethics and of providing misleading information.
  2. You can trust a man who for the past 16 years that we've had the privilege of watching him on and off the field has proven to be one of the most upstanding people in our society.
Personally, I am going to with option 2. The reality is that it's negligent and malicious for the NFL to make accusations that they do not have the evidence to even support being any more than probable, this isn't a game of Keno and I'm disappointed that the league would be so damaging to 1 of its all time greats without even having a definitive conclusion.

Im dead center in calling this crappy wells report on its BS, the NFL and its pro-wrestling style self-promotion, and I have every reason to defend Brady based on his public persona, AND I am doing this here in the Midwest with zero support. Some context for what I'll say next.

I always stop short of selling public people as heroes. I doubt you know Brady. He could beat his kids for all we know (unlikely, obviously). He could be murdering people on the side (Hernandez was a favorite of mine, I crossed paths with him when I was in high school). Without fail, these people that get built up end up tragically falling, if only because of the unreasonable expectations we put on them.

Personally, I only know of a couple of "most upstanding people in society", and none of them are famous. Just my context and 2 c.

However, based on what we know, those calling Brady a cheater can GTFO.

Here is another thing we don't see brought up enough unless it is in a guilty damning condemnation of Brady.

Why would he give his cell phone to Wells? After the all the defaming leaks to the media through this witch hunt, why would Tom Brady of all people turn his cell phone over to this clown? The nationally recognizable character that everyone wants the inside scoop on. Sure he posts on Facebook what he wants the public to see. But why would he trust Wells to keep everything else secret when there is nothing to this point that has been. Some of Mcnallys personal texts were released and they are not even part of the investigation. Imagine how much someone could get or how much you could damage someone's rep by their cell phone? Especially someone like Brady where even the most little thing would be plastered on every major media outlet in the country. I'm almost laughing at the public outcry over this.

It's just proof that there are extremely vindictive people in the NFL front office, starting with the commissioner, that loathe Brady and the Patriots

In the end, I hope public opinion questions the integrity of the NFL not Tom Brady. Irony intended - the League has taken the possibility of deflated footballs and blown it all out of proportion.

I've prosecuted and defended actual criminal cases for 36 years. This has been a total BS setup job from the first day. This was indeed lawyer speak. Proof beyond a reasonable doubt is reserved for criminal cases. The greater weight (preponderance) of the evidence can prove a civil lawsuit. Probable cause can get you inside someone's house or arrested. More probably than not (with no actual proof) that someone deflated footballs is meaningless.

Here's how everyone cuts their losses though nobody has this much sense: Fine the Patriots $100,000 for their "suspected" tampering with footballs and turn this sum into the league after it is received from the Jets for their "actual" tampering with a Patriots player. If actual player tampering costs $100,000, then conduct that was "more probable than not" tampering with footballs shouldn't cost more than this.

While there are plenty of valid defenses to Brady's refusal to cooperate phone-wise, that isn't one of them.

The investigators gave Brady the option of having Brady's lawyer send over only those things Brady's lawyer felt relevant to the investigation, with the phone never getting within a zillion miles of the investigators. So for Brady there would have been zero risk of some personal thing being leaked.

I choose Brady anyday, but I'm just exhausted of this whole thing. Just waiting for more of the smoke to be cleared before making any more judgements.

or option 3......take off the Patriots colored glasses and apply common sense. It's liberating

I'm a Brady fan but it's not a matter of trust. I don't know the guy, really know him so I have to look at the evidence which at the very best is underwhelming. It's a NY league office hit job. The 2nd one we've received. Thanks to Kraft's "Thank you Sir! May I have another?" response, there will be more to come.

And if he answered "There isn't anything," would that be read by Wells as refusal to cooperate or an absence of information? One of the objects lacking from the report is precision in explaining these requests. Is there something in this behemoth of a report that specifies the request, for example "Disclose any text messages or e-mails that discuss the pressure, condition or procedures governing the handling of game footballs"? Attorneys work on vagaries, which is why the civil rules typically require requests in writing and unambiguous. Search case law with "fishing expedition" and you will see why specificity is required by law. These 'safe' requests may not be as safe as you believe them to be, because they lead to inevitable follow-up requests that may put you in the same swamp you wanted to stay out of. When attorneys self-proclaim how reasonable they are being in published documents, it is often safe to assume they are being anything but reasonable. Otherwise, the facts speak for themselves and lead the reader of the document to that conclusion naturally.

This.

Brady works hard at managing his public persona and thanks to a good PR team has well-manicured, tightly controlled public image. You can count the number of public missteps on 1 finger (Moynihan and even that's questionable). He also is intensely private and even the glimpses in his private life are managed.

He exercised 100% good judgement for not turning over ANYTHING that can be used against him or put in the hands of an organization that is THE WORST at crisis control and managing information. Plus he doesn't trust those jackles and that alone is a good enough reason to keep his private life private.

Did you really believe a word you just typed? So I am understanding you correctly? Brady's lawyer is supposed to sit down with Brady's cell phone and sift through all his texts and emails looking for anything pertaining to deflating footballs? Send anything he found over to the Wells team and then that is considered cooperating? You actually think Wells would be ok with that scenario? The answer is no. Wells wanted the whole phone and full access to everything in it with the scouts honor guarantee that he wouldn't divulge anything else besides what's relevant to the investigation.

And if he answered "There isn't anything," would that be read by Wells as refusal to cooperate or an absence of information?

And that is one of the quite valid reasons to refuse to give them anything at all.

I have no problems with him refusing to give them anything at all.

I'm just saying that "well, the reason Tom didn't want to give up his phone was because he didn't want those rat bastards to leak his contact list, or raunchy messages from Giselle, or whatever to the world" is BS.

From page 21:
Wells report said:
we offered to allow Brady's counsel to screen and control the production so that it would be limited strictly to responsive materials and would not involve our taking possession of Brady's telephone or other electronic devices.

Anyhow, Brady did the right thing in refusing to give them anything at all.

All I'm saying is that fans should own up to his refusal and not try to claim Brady refused because he was worried about leaks of personal stuff.

Common sense tells me that it is "probable" that you're being a troll here but I don't know for sure.

I have wasted very little time with this fiasco .......... that's my choice.

I eagerly await the camps and reports from them ...........

I'm in the same boat with you, unless Brady is suspended I couldn't careless about the entire situation. At the end of the day being good at what you do has and always will make you a target for allegations and the haters who aren't capable of doing what you do. That is the case in the NFL and just about every aspect of all our lives.
