How else do you explain taking Goodell's statements at face value despite the fact that he's on the record as lying repeatedly throughout the process?

Doesn't matter. If your the arbitrator, you basically can do whatever you want. Misconstrue. Lie. Change the rules on the fly. Whatever. The US court system says you can do whatever you want as an arbitrator.

Brady's lawyers really blew this one. He must be livid.

Again, the whole idea of the science exonerating was pushed aside in favour of more legalistic arguments. It seemed as though everyone involved, and some people here, thought that was too simple of an argument for a highly skilled lawyer like Kessler.

I was screaming from the rafters that it should be argued there was an implied term in the contract between the Union and the NFL that actual wrongdoing take place before any punishment can take place. And following that argument, proceed to demonstrate the science. But no, too simple an argument, wasn't sophisticated enough. This has to be about procedure. That was the argument that makes you a sympathetic party in the proceedings, and that's totally ignoring the ancillary benefit to Brady of clearing his name publicly.

Nope, everyone was too smart for that argument.

What I don't understand is, right after the NFL filed the appeal, all the legal experts were saying the NFL only had like a 13-20% chance of winning. How the **** did this happen ?

I still shake my head at how the NFLPA gave the NFL carte blanche on discipline through this absurd arbitration structure.

If the arbitrator acts within the scope of this authority, the remedy for a dissatisfied party “is not judicial intervention,” but “for the parties to draft their agreement to reflect the scope of power they would like their arbitrator to exercise.”

If they had known Goodell was going to go rogue, they would have changed it.

But it's also worth pointing out that, except for monetary issues, Goodell's arbitrary disciplinary powers was apparently the #1 thing the NFL was insistent on holding on to in the most recent negotiations.

Honestly, reading this this makes two things abundantly clear:

1) the judges have absolutely no clue about the subject matter that they were presiding over. I'm not sure they could pick a football out of a lineup.
2) they're either stupid or so ideologically anti-labor that they're incapable of acting with any basic intelligence or integrity. How else do you explain taking Goodell's statements at face value despite the fact that he's on the record as lying repeatedly throughout the process?

Either way, doesn't instill much confidence in the US judicial system.

they're hiding behind the 'process' and ignoring the evidence no matter how loud it may be. conservatives are already on a phenominal track of destroying how they are viewed to the general public.....hte pendulum usually swings back pretty hard the other way.

You have to blame the players for signing off on the CBA.

Not just him. It would seem that anyone operating under a sloppy CBA can now get away with murder.

SCOTUS gutted appellate review of binding arbitration decisions a while ago. This is bad, but it was known, and the NFLPA should not have granted this structure to the employer, in which it alone is able to serve as a binding arbitrator without any real recourse to appeal based on the facts of the case.

My critique of organized labor as such comes with support of the larger project, of course, but in this case the union can and should be blamed, along with SCOTUS for stripping away those protections in the first place. The judges merely did what they were going to do, pursuant to the collective bargaining agreement.

I was actually planning on going to the AZ game. I have friends out there, and we were all planning on showing up. Held off because there was no way I was going to pay to watch Brady suspended, so I wanted to make sure he'd be playing.

Glad I did. The NFL will not receive another dime from me.

It's worth reiterating that two of the three judges (and one of the judges that decided to reinstate the suspension) was appointed by a Democrat. Even America's 'liberals' are no friend to the common man.

It was clear from the start that chin was not going to support brady. Parker was the one who was 50/50.

They are corrupt as all hell. They have been paid off. Either with money or other benefits. Republiturd, Demiturd it doesn't matter. Sooner people realize this we can save this country. There is so much wrong here. It's impact is far from just TB and the Patriots.

To tell a federal judge thst he has to rule, and rule hoe they want is very totalitarian. I was unaware of such a process.
