Whether I followed that up with a Motion to Dismiss would depend on whether she stated a prima facie case in the Complaint. I agree with your main point, though, which is she would never file suit in the first place because it would be monumentally stupid and open herself up to potentially catastrophic damages. I hope she does try and sue Pablo, because it would be wildly entertaining.No. Just no. IF she ever actual files suit...
The first thing Pablo will do is file a Motion to Dismiss (unless he actually wants to go to court).
Torre is a reporter so I am wondering what in the heck basis you think he has to file a counterclaim against Bill and/or Bunny that wouldn't be dismissed in a heartbeat. If/when Pablo's hypothetical counterclaim is dismissed, then there's no discovery.
