Unofficial reports are saying he was .12, over the limit of .08.

What a sad story all the way around. The worst, of course, for the family of the deceased. And also for Stallworth who faces 15 years minimum if this is true.

Sigh.

It is sad for all parties. Especially the deceased and his family. But I can feel for Stallworth too. I've never understood the over limit rule and how much it takes the average person to blow a positive. My friend and I had 2 beers at a pub on our way home from work and he got pulled over for having his taillight out. Needless to say he got a dui.

Every case is different, for all we know Donte didn't even get a breathalizer for an hour or more after it happened and still blew a .12 which makes it even worse. I'm sure some more facts will come out as they move to a trial.

Your friend was not telling you the truth. At 2 beers, he would be at around a .04, well under the limit and that's not even factoring in time afterward where the alcohol would be metabolized. Depending on weight, your friend would have had to drink 4 beers then drive to reach a .08, and the body metabolizes about .01 to .02 % per 30-40 minutes.

There is a standard rule that if a guy says he had "two beers", he usually had 6 or more.
