So even if Brady did it, the NFLPA contends he can’t be suspended for it. While P.R. considerations prevent the union from putting it quite that way, that’s the crux of the argument. And given the many limitations on what otherwise would be the ability of the Commissioner to cry “conduct detrimental!” and impose whatever punishment he sees fit at that moment, the NFLPA’s argument has plenty of merit.

both arguments are really no different than the saints players, rice and peterson. which is why I believe brady will win. goodells argument in all of those was "I can do what I want article 46!!!"

The NFL has lied about most pertinent facts. This has been happening since day one, with the Gardi letter. Blatant lying. They continue to do it with the "we don't have to have an independent investigation, really", after they've preached for months independence.

I really can't think of any organization that can lie like that and not be under federal investigation. This isn't childs play. This is a multi billion dollar industry and the leaders lie their asses off all the time.

And this organization is operating under an antitrust exemption. We all know that Kessler's holy grail is taking down the NFL's exemption. I dunno if this case can help with that, but I can't imagine that the league engaging in blatantly anticompetitive behavior hurts his cause.

He was an employment lawyer before setting up PFT so if anybody is used to reading briefs and framing arguments as well as interpreting the law, he has more credibility than say ESPN's legal analyst Lester Munson who hasn't practiced law in 20 years and was disbarred....

Good observation. It's very possible that Schefter has been silenced by the long arm of the NYFL. Too bad. He was one of the few mediots that I trusted.

It could also be that he was instructed to hold back on the negativity about the NYFL and he didn't have anything else to report.
