Could NFLPA file grievance over handling of Moss???

I was just thinking about how big of a fiasco this has become for the Vikings. I think that the NFLPA clearly has grounds for a grievance on behalf of Moss.

Here's my reasoning:
1) Childress notified the rest of the team about Moss being waived, but didn't notify Moss or his agent.

2) The paperwork was not filed prior to Childress notifying the other players.

3) The paperwork has not been filed since Childress notified the other players.

4) At the end of the business day, Moss nor his agent had been contacted by the team to notify them of what the situation was.


I could see Moss being declared a free agent because of the clear lack of professionalism by the Vikings Organization.

I could see Moss being declared a free agent because of the clear lack of professionalism by the Vikings Organization.
There is no way whatsoever the League declares Moss a free agent due to the Vikings' incompetence. If the Vikes try to change their mind (since they apparently haven't filed the actual paperwork) I could see the League forcing them to go through with their waiver, but there is no way in the world the League just goes ahead and makes him a UFA. About 30 other owners would have an absolute fit.

This has nothing to do with the 3rd round pick. It has to do with the Vikings not having followed the rules of the CBA in terms of how they handle the release of a player.

But does the CBA specify that a coach can't randomly tell the team he's planning to release a player without filing paperwork or informing the player? It seems more like a violation of courtesy and common sense than contractual obligations.

I doubt there is any specific clause that says "You cannot announce a player is waived to the locker room" or anything like that, but this does raise some pretty interesting questions.

For example, when WEEI asked Bill Belichick if he would be interested, he was smart enough to say (paraphrasing from memory) "I can't comment on players under contract with other teams. I don't even know if the reports he was waived are true." But we have heard reports that the Dolphins and Seahawks are interested and may have contacted Moss' agent. So now are they on the hook for tampering?

Mmm, interesting indeed. I'd think if the Vikings were crazy enough to cry "tampering," other teams could have the equivalent of an entrapment defense.
 
I could see the teams cotnacting the agent and the agent saying nope sorry not where he wants to be he'll just go inactive untill he gets the team he wants. or if teams were smart have no one claim him then he thinks his value is low and get him for the cheap

I seriously doubt there would be any repercussions for teams contacting Moss's agent under these circumstances.

That is why I think that the NFLPA will try and get Moss declared a Free Agent. Because teams have contacted Moss' agent in regards to his Moss.

As for whether there is specific language in the CBA on how it's handled, I would be willing to bet there is, somewhere. Especially since there are things like play-books to collect.

Also, by not filing the paperwork, they have, essentially, created a hostile work environment for Moss. Since it's clear that the Owner/Coach do not want him there, while many of the players/other management do. It's a situation that is almost impossible for Moss to go back into and be productive. And, if as the Minnesota paper mentioned earlier today, that Ziggy gave Childress his blessing to ditch Moss, then just firing Childress won't work.

Yes, I agree. As another poster also said, there wouldn't be any repurcussions for teams contacting Moss' agent under these unusual circumstances.

Man, are they messed up in Minny.

Well, Ziggy would have to have a huge change of heart. According to one of the Minnesota Papers this morning, Ziggy was giving Childress his full support.

If that is the case, I can't see Moss returning there with Ziggy still the owner but Childress gone.

I still think the NFLPA is going to end up involved..

yeah i was definitely thinking the same thing. Specially everyone was informed before moss.
