Rex and Bud were employed by or in ownership at the time of their indiscreet behavior. Spikes was a college kid with no ties to the league or any team at the time. That someone else released a tape of the indiscretion once he was has nothing to do with him and his behavior as a member of the league. This isn't the Miss America Pagent...
I was responding to the bit about not being able to fine players for legal activities. If you are an NFL player under contract and commit some offense, it certainly is possible according to the vague language of the PCP. In Spikes' case, and I've already said this at least twice, I don't see anything happening other than a lecture. This is for a couple of reasons. 1) He was (likely) in college at the time, and 2) Goodell tends to forgive relatively harmless first offenders (the Pats notwithstanding). But the broader point is that if Spikes did this a second time or after a warning and while under contract to an NFL team I would not be surprised at all to see Goodell apply the PCP and institute a penalty. It's well within his power. The distinction between legal and illegal activities doesn't really apply to the PCP based on the way it's currently written. Unlawful activities are a problem, as are activities that are counter to the best interests of the league. It's an insanely broad provision.
