There is a window when the hit is late and isn't. He was in the air while the ball was released like wtf do you think he should've done? Entered the Matrix and gone around the QB entirely?

You can turn your upper body when you're airborne. Even if he still came down into him, as long as his arms didn't strike him the way he did, refs might have viewed it differently.
