He acknowledged that doing that wouldn't hold up on appeal, since legally all Berman can do is affirm or vacate the award. Florio's speculating that maybe if Berman handed down a 2 game suspension, neither side would appeal.

To the contrary, I'm pretty sure both sides would appeal that (is that even possible?) since neither would be getting the only thing that really matters to them. NFL wants acknowledgement that Article 46 is all-powerful, Brady wants vindication. It's a stupid theory, and Florio really should have stopped with that line of thought the moment he arrived at "legally, the judge is not allowed to do this..." and before he somehow found his way to "...but if it maybe doesn't get appealed, who cares??"

Exactly if they wouldn't appeal that why wouldnt they have settled for that?

Just heard something on the radio that made me chuckle.....that Brady should do a cameo in the new concussion movie, especially if they uphold the suspension, kind of like a iyour face to goddell and the nfl office. Lol

absolutely. First thing I thought when I read the NYT front page article this morning. Either a cameo or a brief exchange with the Will Smith character in post production. The piece in the Times, based on the hacked emails, suggested that Sony allowed the NFL to influence the story line. What a way for Sony to slap that down...and raise the Buzz at release time;

Brady has got to win this one. According to Daniel Wallach, less than 10% of decision that make it to the Second Circuit Court, are ever reversed after appeal.

And I'd tend to think that this would be of the utmost importance if he ruled for Brady (vacation of the award).

Reasons being twofold:
a.) Brady is less likely to appeal (should he 'lose') given the potential of missing time later in the season.
b.) The bar was set high for Brady to begin with. Should he choose to 'appeal the appeal', the chances of him winning said appeal would be infinitesimally small.

The opposites apply should he rule against the NFL. The NFL would very likely appeal Berman's vacation, and moreover, the bar would be set lower for them (with regard to providing satisfactory evidence for an overturning of Berman's ruling).

In other words, Berman needs a particularly strong ruling should he side with Brady. The wording, legal language, etc would need to be impeccable. This would be less important should he rule in favor of the NFL.

Just another ruling in favor of management in a labor arbitration case is pretty much appeal-proof already.

Having the courage to do the right thing and side with Brady is the position that takes some work to make appeal-proof.
