For starters, you have to show that the discover-able information was actually lost. If Brady can show he saved the cell phone data (or it's available by other means), than there's no harm.
Again, I don't believe Brady was ever advised to (or would be stupid enough to) destroy evidence while he was under investigation.
If this was a legal strategy to get Goodell to take a legally untenable position, then I say . . . well played!
This is like a cop pulling you over and ticketing you for speeding, but when you show you weren't actually speeding, he says "well, you were driving a sports car so I just assumed you were speeding." Driving a sports car is not illegal, you can't ticket someone for breaking a law/rule and then change the reasoning to something that isn't wrong when the original issue is debunked.
Lol, when a judge asks Goodell "can you show an actual rule violation definitely occurred?", I don't think "Brady destroyed his phone!!!!!!!!!!!!" will be an acceptable response.Amen. There is no chance of the phone ever being required for evidence unless there is a suit files by Brady against Roger for slander, etc... This is a 100% unfair labor practices issue now and Brady is entitled to all his union bargained rights. NFL walked right into this legal trap.

In the interest of honesty, I did not come up with this theory, a labor law judge who handles union issues every day did. I am sick and at around 50% brain power now.
I dont think the nfl lawyers rendered this without anticipating the court appeal. Iam sure they will have enough to protect themselves. Considering what has gone on in the bizarre story Iam not 100 % confident liek the others about the court stuff.
