NFLPA's official Brady appeal letter....Whoa!

Personally I dont think it was a sting by NFL . The colts notified the league which didnt take it seriously but the colts along with kensil also did their own sting . Once it all came out, the NFL tried covering up first by blandino saying they were unaware and then wells stating there was a letter to the league the day before and wells again in his presser messing up saying it was ignored.
Basically these guys are so disorganized even with their own stories that its pathetic.

It certainly played out like a sting and a witch hunt. I just can't get past the fact the intercepted ball measured at 11.45 and all the balls measured at 11.49 as per the gauge the ref said he used. Those were the expected measurements. When they started investigating, they knew nothong about texts messages or pee breaks. It was weeks maybe even months after hiring Wells that Exponent made the argument that the non logo gauge was used and began playing around with transient curves (which used completely unreliable data) pushing the Pats balls four whole tenths of a psi below their expectations. This was a witch hunt all along, maybe even a sting.
 
How are the other owners standing by and watching this all happen?

That is a very good question. Something tells me there will be an owners meeting soon. sh?" is about to hit the fan.
 
If I'm understanding this correctly.. the CBA forces Goodell to hand out all punishments, but also makes him the default arbitrator? How is this possible?
That way the defense can say in court that goodell was biased, therefor if he up holds his own punishment the court would step in and say n0, thats not reasonable. In fact i think a judge in missouri has already made that judgment.

Jones is not just standing by, he is letting his son pile on by issuing wussy statements of support for Goodell--of course, Kraft has done the same thing.

You're missing one key piece: Blandino was one of the NFL officials notified in the e-mails, and per the Wells report he was one of three NFL officials who talked to Anderson before the game.

Blandino, interviewed during the SB, claimed no prior knowledge of the Colts grievance. That's a HUGE piece of evidence in any 'sting' allegations.

Further, the leak to Mort, where did it come from and why wasn't it corrected? The sting doesn't just have to be in-game checking of PSI, it extends to the NFL announcing an investigation into footballs despite the public having a false understanding of what was being investigated. Brady and Belichick gave press conferences based on the false information, they defended themselves and the team and had to attempt to explain what could have happened to the footballs for them to have been deflated by 2 psi.

The 'sting', as I see it, is both related to in-game procedures not being followed and NFL personnel trying to catch the Patriots deflating footballs; and the post-game leak and misinformation campaign by the NFL that resulted in national outcry and an independent investigation. In the former Blandino, Kensil, Vincent and others are involved, in the latter Vincent, Goodell, Kensil and others are involved. All of them should be considered witnesses in any trial related to this situation. Meaning Goodell can't oversee the proceedings.

Which also begs the question..... Does the League office have legal advisors?

That may sound like jest, but I'm totally serious. When Goodell, says to Troy "Hey, how bout you handle the discipline and then I'll be able to handle the appeal"........ Isn't there SOMEONE there that say's "whoa chief, slow your roll a bit. The CBA explicitly states in section bla, bla bla, that you cannot transfer this authority to anyone else".

Seems to me that simple legal counsel would have been able to stave off a lot of the crap that Goodell is raining down on the sheild.
 
I think that the "sting" line of defense is hugely plausible and likely the most DAMAGING to the shield.

It's most damaging because the sting and the immediate judgement and the league media leaks and preventing the Patriots from countering any of that is the basis of the defamation lawsuits that are coming from Brady, McNalley, Jastremski, and the New England Patriots.

It's a mistake to think that any of this is about the four game suspension at this point.

Won't Goodell just officially suspend Brady then keep himself as the arbitrator per the CBA?

Brady of course could try to fight this in court if it gets that far but a court case could take years before an outcome is reached.

No, you can't repunish someone if you F'd it up.

It gives Goodell an out to turn it over without saying Brady is innocent to appease the public. It does not get him out of a defamation lawsuit though.
 
Looks like those crazy kids Brady, Dee Smith and Kessler were playing on the computer and that letter shot out.

Loophole, or more evidence for the Brady camp to push for a neutral arbitrator that has clue how the CBA works. This is perfect evidence to argue the "Look, this dummy doesn't even know the basics of who can issue this type of discipline. How can we expect that he can arbitrate correctly once we start using big words and using markers instead of crayons"
