Has the NFLPA decided not to seek injunctive relief with regard to the appointment of Goodell as arbiter? Now that the date and arbiter are official, I would think that the NFLPA could ask a court to require a neutral arbiter.

IMHO, their court position isn't stronger if they wait until after the appeal is lost and then ask the court to set aside the findings.

The strategy of waiting until after going through the CBA worked just fine in the Bountygate case. They may well be repeating that.
 
I just don't think with a late June appeal there is enough time, brady might not play game one. Not sure but it feels like the window is closing fast.
 
Another question. If this goes to a real court and it finds that there is a 99.8% likelihood that nothing untoward happened, how can the nfl stick with its team punishment?

The Saints still served team penalties after bountygate player penalties were thrown out. The NFL will just hope that nobody notices.

They will go through the CBA process. Then when goodell upholds/slightly reduces the suspension, The NFLPA will file to vacate the arbitration award with the courts.

Adrian Petersons case is a good timeline to follow.

Assuming the appeal is a sham and this goes to a real court, any timeline on how soon that could happen? Guessing very little chance a case could be heard before season starts (but some of ruling to put suspension on hold), does this get resolved in middle of season, or after the season altogether?

Goodell doesn't want this in court.
While I hate to put myself in the mind of a vicious idiot like Goodell, if I were him I would vacate Brady's suspension. That way, Brady has nothing to appeal and (correct me if I'm wrong) the Patriots would still lose the picks because they agreed to accept the penalty.

AM I wrong about the last part? Can the Patriots come back and say "since Brady suspension was vacated and Wells report said the Patriots organization itself did nothing wrong" can we have the picks back as a matter of fundamental fairness? Of course Goodell has no grasp of fundamental fairness so is there any way the Patriots could press the issue when he inevitably says "no"?

If Kraft had appealed, he might have somewhat of a case. By not appealing, the NFL coulda argue he waived that right.. Thanks Bob.......

Really close. But mind you Christmas and new years is not in the way. But ya, It is going to be close, real close to the start of the year.
 
Can Brady's legal team argue that Brady's suspension AND the loss of draft picks are penalties against Brady, because his professional responsibility is to win football games and both are obstacles to him being able to do so, therefore he can pursue legal action to have both vacated. If he can show that nothing happened with deflation, why should he be penalized by having to play with a less talented team?

I know, it's a stretch, but what the hell.

3 points the NFLPA is fighting Brady's appeal on.

1- The CBA grants the Commissioner—and only the Commissioner—the authority to impose conduct detrimental discipline on players.

2 - Mr. Brady’s discipline cannot be sustained for the additional reason that it contravenes the governing CBA requirement of fair and consistent treatment. See Rice at 16; Bounty at 4.

3 - Mr. Brady’s discipline is premised solely upon the Wells Report, which contains insufficient evidence to find that Mr. Brady committed any violation of NFL rules.
 
Goodell doesn't want this in court.
I disagree. After he upholds some suspension he can say to the other 31 teams, "I tried," then get it over turned and say to Kraft, "I knew that would happen."

Nah, Goodell does not, or should not want this case in court b/c of the precedent it would set. In regards to Goodells powers to just arbitralary throw out suspensions on conduct detrimental to the league BS.

Greg Hardys suspension is something goodell does not care he would lose in court. B/c Hardy is the last of the scum bags to be retro activitly hit with punishment under the new domestic violence rules. That is a case he can throw up his hands and say he tried.

Brady's case has far more reaching consequences for Goodells powers if he loses..
 
The first thing I bring to the table in federal court is the Kevin Faulk first down on that 4th and 2 that the ref said wasn't...with a just hired Kensil lurking on the Colts sideline giving fist pumps...from there, roll out the entire organized criminal conspiracy riddling NFL offices since the Goodell hire.
