The NFL makes itself difficult to sue. It has had recent losses, however, around player discipline. While the NFL would like to rule that Goodell hears appeals of his own punishment, and it stops there, if Brady demands an independent outside arbitrator, he will like win a court case to get one. And if the timing of such a case makes it look like he'll lose games to suspension before the case is resolved, then either an injunction or an acceleration of the case is likely. The NFL would be well-advised to just concede his demand, claiming it was doing so out of un-coerced magnaminity and an abundance of caution. I wouldn't be surprised if it followed just such a course, and I think Yee's blast today is designed to encourage the NFL to do so.
That, so far as I can tell, is the good legal news. Is there any other legal recourse that's likely to succeed?
