As I've said multiple times -- approximately the only thing that is commonly gracious and generous about court cases is their scheduling.

Usually, this redounds to the benefit of the lawyers, which is surely why it's the way it is. But if they have a strongly seasonal occupation -- e.g. football -- it usually works out reasonably for the civilians as well.

ESPN's Chris Mortensen, reporting on the delay in the federal appellate court hearing on DeflateGate, said that a sweaty man wearing a brown paper bag at NFL's New York headquarters told him that "Commissioner Goodell has asked Ted Wells for a refund of the $4 million it paid Wells' law firm to get Patriots quarterback Tom Brady suspended for four games to guarantee that the Patriots would not appear in Super Bowl 50." Mortensen could not be reached for comment.

 
No mention in the article, but does anyone know if the judges have been named? Or, if not, when they will be named?

I looked up the court rules on the 2nd Circuit's website and double-checked with a lawprof friend. They name the judges the week before oral arguments (can't remember if exactly a week before or the Monday of the week before).

And, no doubt, Brady was "at least generally aware" of that fact...

thanks. they're quite a range of potential ideological viewpoints based just on a read of their backgrounds.
 
He's described as an international lawyer as the chair for global anti-trust cases for his lawfirm and the co-chair for sports law. He has taken and won cases all the way up to the Supreme Court but he doesn't seem to specialize in appellate cases like Clements.

Thanks. The guy is obviously as competent as they come. I wouldn't be surprised if they bring in an Appellate specialist as an Advisor, but Kessler will be in charge clearly.
