If Tom Brady's appeal of his four-game suspension is not settled and federal judge has not yet ruled on the case, an NFL source tells ESPN's Sal Paolantonio that Brady's suspension will start on Saturday, Sept. 5. That's the day NFL teams must reduce their rosters to a maxium of 53 players by 4 p.m. ET. What is not known, according to the source, is how the litigation will affect the Patriots' final roster. U.S District Court Judge Richard M. Berman said Wednesday during a hearing on Brady's appeal, that barring a settlement, he hopes to rule by Sept. 4, but that is a quick turnaround for him. Both the NFL and NFLPA have asked the judge to rule by that date, which is six days before the Patriots' season-opener against the Steelers. This means that it's possible that as of Sept. 5, Brady will be barred from entering Gillette Stadium if his case is not decided.

Right now the ruling stands and all penalties are in full force and effect... but that can change by Sept. 4 either through some settlement or court action..
 
Should that happen I can see the union calling the players out on strike.
 
Actually, as it stands now, the report is 100% accurate. However, if the case takes longer than both Brady and the NFL asked for, he (obviously his legal team, not Brady himself) can file for injunction. I think the fact he case took longer than expected and that not granting it would make the judgement moot would be a valid grounds for granting it.
 
Brady is currently suspended. The suspension is in place, there is no injunction to prevent it. The parties agreed not to seek an injunction in exchange for seeking expedited relief from Judge Berman. I don't know the league's rules regarding when a suspension kicks in, but it was widely reported many weeks ago that Brady would be able to practice all of camp and play in preseason games, but then his suspension kicks in.

If Brady/NFLPA wins before Judge Berman, his suspension is lifted. The NFL has the right to appeal to the Second Circuit, but Brady would not be suspended in the interim. If the NFL wins before Judge Berman, then Brady has the right to appeal to the Second Circuit. If that happens, he would have to seek an injunction, and this could take at least a few days.

But long story short, I think that report is accurate.
 
Just for my knowledge, the injunction signifies what? A temporary hold on the penalties of a case .Just curious how it works.

Yes, more or less. To get an injunction, a party has to show that it could suffer some form of irreparable harm (e.g., loss of salary and inability to play in games). So basically, Brady's suspension would be put on pause, pending a decision.

If no decision is reached, Brady would be suspended for the 9/10 game.
FWI In order to play, he would have to file for an injunction. Having an injunction granted is not automatic.
