It is perfectly reasonable to go after the picks now. Just needs to word it delicately.All he needs to say is, "In light of the US Federal Government validating what we believed which was that the process the NFL followed in determining our team's involvement and subsequent guilt in deflating footballs was faulty and lacked sufficient evidence, I have decided to explore our options in recouping our draft picks.".

Disagree. Based on the Wells Report, Kraft said, "we disagree with the punishment, but we'll take it." Berman's decision does not take issue with ANY factual findings of the Wells Report, including that Patriot employees more likely than not deflated balls. Kraft screwed the pooch, but he can't make it any better by going after the picks now. That ship has long since sailed.
