NFL attorney says NFLPA's move to vacate Brady's Deflategate suspension is 'baseless'

Just makes my blood boil reading everything dan nash says and frankly is worrisome

The commissioner didn’t discipline him because he was generally aware. He concluded after listening to Mr. Brady and assessing his credibility that he was involved, not just that he was generally aware. …

“They also cite things like the competitive integrity policy, the equipment policies were not sufficient. Again, they’re misstating the facts. He wasn’t disciplined under the competitive integrity policy. He was disciplined under the broader and longstanding provision, both in the collective-bargaining agreement and in his player contract, where he acknowledges and agrees that the commissioner has the authority to discipline him for conduct that’s detrimental and it affects the integrity of the game.
 
I won't lie, reading some of this stuff worries me:( I know I've watched way to many movies but man with everything that's happened let's just hope goddell don't already have the judge on his side. Goddell just seems to confident. I so hope that smile gets wiped off his face.
 
So their own attorney's don't even know the case *Wells " I don't want your phone." and I'm assuming they pretend they don't know the law around King of the Clueless, Goodell.

Nice of them to just ignore the judges wishes to shut up and be ready to compromise, though. Should be a laugh riot this week.
 
Troy Vincent's letter to Brady on punishment:

With respect to your particular involvement, the report established that there is substantial and credible evidence to conclude you were at least generally aware of the actions of the Patriots' employees involved in the deflation of the footballs and that it was unlikely that their actions were done without your knowledge.

Apparently this guy can't be bothered to read what the punishment said.

I think they are claiming if i can understand it correctly that the arbitrator goodell upheld the decision solely because he felt brady had no credibility in his own eyes because he heard brady say he destroyed the phone not because he heard and read only what the appeal was and what wells said before etc etc and that the CBA gives him a right to do so.They are ignoring the wells report -generally aware to say that the commisioner took some kind of executive decision and he has the right under the CBA.

Well he ignoring the original punishment saying this is goodell making a comissioner decision because he feels brady didnt have credibility in the hearing. Helps when the arbitrator and commissioner are the same.

It's going to come down to whether the Judge will consider the findings of the Peterson case or not. If not, he will find that Goodell was within his rights under the CBA. Still could go either way. I *hope* that the judge respects the spirit of what the NFL is trying to do here, which is essentially moving the goalposts. But who knows.

True but all we have heard so far is that NFLPA's case looks good . This is the first time someone is attacking everything from the PA saying they are wrong because the CBA says we can say so.
 
I just hope Judge Berman reads this and slams the NFL for disregarding his edict to turn down the rhetoric! Way to go NFL lawyers ... piss off the judge!

I thought he was not allowed to change or increase the punishment at an appeal? He's inventing new justification because he knows Kessler is right, and he has no argument.
 
When my two young kids argue, one will say you did _________(fill in the blank) and the other will say Nuh Uh.

This is the NFL saying Nuh Uh.
 
Notice there was no question or anything about why did the appeal decision have a blatant lie in it. Or why they lied in other circumstances. These morons are just as bad as the mob, their way or the highway. Everything that comes out of these slimeballs mouths is full of deceit and lies. It takes a small person to acquiesce to being a mouthpiece for these soon (should) to be convicted felons. This guy should be disbarred along with Wells, Pash and any other NFL council who has had any input into the proceedings.

Just because a lawyer makes an argument and cites existing contracts and legal precidents, it doesn't mean that they are right.

Seems that they've tried to settle and have reached a stalemate- again. So it seems at this point it doesn't make any difference.
