Freeman: Goodell will Hear Brady's Appeal

BTW, this is a way for Goodell to get out of this, at least in regards to Brady, in case people are missing it:

Overturn all 4 games of suspension
Fine Brady for his so-called lack of cooperation

The question is whether or not Goodell will take that lifeline.

Posts coming in fast so sorry if this has already been said. I wouldn't be surprised if this is a strategy play by Goodell. He listens to the appeal and based on "new scientific testimony" and other factors, completely exonerates Brady and the Pats. "Hey Bob, buddy, pal. Look what I did? I thought y'all were innocent all along. It was the other guys, Troy and Ted."

Nothing would surprise me at this point.
Your scenario would!:)

In my opinion, no one should be looking at any of this with the hope that either media opinion or public opinion will be changed regardless of the final outcome. Everyone's minds are made up forever. Verdict: guilty, no matter what happens going forward.

Fine with me. Their hate is like the sweetest wine.

Yeah, I am no lawyer, but this move seems to all but guarantee Brady will lose his appeal, but strengthen any legal case against the League.
If Brady doesn't have it wiped out or brought to a joke fine, he goes to court, says that Goodell was not neutral and gets a judge to require a neutral arbitrator. He can sue on top of this but this is how the appeal process works.

This is exactly why he appointed himself arbitrator. Bastard. Take this straight to court. Let this lying scumbag stand by his so called suspension in front of a judge.

So exactly what does this mean? I mean do they actually have to go through appeal process with goddell before anything else can be done? Or can they still fight now for someone else to hear the appeal?

There is no way this gets resolved on appeal. The NFLPA has always hated the fact that Goodell hears these appeals. There is no bigger opportunity to blow up that power than now. There is no higher profile player in the league and the NFLPA is probably giddy about helping Brady take this to court.

That'll hurt him in the public opinion arena, will never happen. And as you've said, he's a true believer - thinks he's right and will fight to the end without thinking of the long term consequences. I still think that he thinks he's made of Teflon.

Yes.

Brady can sue for defamation etc... but as far as the appeal, next stop Roger. In someways its better as it gets his fingerprints on the mess.

If I am Tom I agree to this and pay my fine but I have one condition: a public Mpology.

The owners are totally unconcerned about labor trouble after the CBA expires, the NFLPA is going to want cha-cha-cha-changes!

I expect that you're correct. I'm just noting that he does have an escape route.

****ing lol

I find it interesting that they had 10 days to decide on an arbitrator, but they announce it'll be Goodell just a few hours after Brady filed his appeal.

It's funny that the NFLPA directly challenged them that if they were so confident in their evidence and report, they should have no problem taking it to a third party. NFL's response? Nope! We are gonna just keep it here... Some confidence.

Great point, but will his ego allow it? Or will he double down on the buffoonery?

From Mike McCann's article on Brady's options and him going to Federal Court with a labor and arbitration claim:

It is also possible that Brady could seek review by the National Labor Relations Board or a federal court to review how the NFL resolves his appeal. Adrian Peterson, with assistance by the NFLPA, pursued this tactic for purposes of being reinstated and it worked. Brady would likely cite two federal laws, the Labor Management Relations Act and the Federal Arbitration Act, and demand that the suspension be vacated. Brady would claim the suspension violates basic notions of fundamental fairness and consistency. Brady would raise specific points referenced above, including that there is no precedent for a player facing a four-game suspension for the type of infractions at issue. If Goodell selects a former NFL employee to preside over Brady’s appeal—as Goodell did with Peterson’s appeal—it would help Brady argue that he did not receive a fair shake.

If McCann thinks Brady can file a claim with Goodell selecting one of his flunkies to hear the case, imagine how much easier it is with Goodell hearing the case.
