Why not. Nothing to lose. I did a quick look up of the 2nd circuit and it seems most of the people are Clinton/Obama appointees. This seems to overall be a case where your ideological perspective comes into play a lot and leftist leaning judges i think are more likely to side with the against the NFL and with Brady.
In the majority opinion a big reason why they sided with the NFL is they came at it with the idea that if what Roger and the NFL did could EVEN POSSIBLY fit even the broadest bounds of the power the NFL had then it had to be allowed.
Why does it need to be interpreted that way?
I think if this goes to the full 2nd circuit or even the supreme court (and with a case this big and well known and with the implications it has it maybe could) then i think it is possible it will be reversed again.
