OT: Chiefs appealing the punishment for tampering

What would the basis of a court appeal be? Is there anything besides a law suit to threaten the league's antitrust exemption? I'm genuinely interested. It isn't like the Brady appeal which was a labor-management issue.

That particular decision would have been up to Kraft and his attorneys. Whether they looked at contract law, fell back to the anti-trust issue, or decided on a different attack, there would have been some avenue they could have tried.

I don't think Jonathan's attempt to lay down cover for his dad is going to work very well, though, do you?

I assume you are talking about Jonathon saying they would only get money if they sued?

Just another example of the Krafts hoping we are stupid enough to take their lame excuses at face value. If something is going to happen that will cause irreparable harm to a claimant before the case can be heard, an injunction is generally granted to prevent that thing from happening before the courts can settle the matter. In this case, either the NFL would be prohibited from holding the draft, or they'd have to let us use our pick and pay the penalty the following year. That, of course, would be if they had a chance in hell of winning, which I don't think they do.

Generally speaking, courts will hear cases involving actions they consider blatantly unfair or egregious, even if the party has waived the right to sue.

I would think the basis of any hypothetical court case Kraft filed would involve that concept. Even Brady's lawsuit was along those lines. His lawsuit kind of says "we know the labor deal says we have to go to arbitration and accept the arbitrator's decision, but the arbitrator's actions were so egregiously unfair that we are suing anyway."

You don't become a billionaire being a 'fan first'. The Kraft's can talk all they want and make all the excuses they want. We all know where their priorities lay....

Seriously though, what is in the legal contract between an owner and the league/rest of the owners? Can the other owners vote out an owner? Does 'attacking' the league void a contract and get you kicked out? We all would love to have seen the Krafts go all Al Davis/Mark Cuban and just tear the whole f*cking thing down, but I'm sure there's a limit to what they can say/do.

I think they need to make a movie about the Pats/deflategate. Mark Walburg could play Jonathan Kraft and just push his father aside and burn the league down.

Since they've gotten exactly nowhere so far, appealing wouldn't have left them any worse off and it would likely have gotten them a chance to go on the record in Court and forced the NFL to respond under Oath and pain of perjury.

In other words, there are no reasonably conceivable circumstances under which they would have been worse off than they are today had they begun an Appeal process that evolved into a legal process and there is a reasonable chance that they would be better off if for no other reason than the added pressure such a process would have brought to bear on the League.

Bob Kraft blew it. He knows it. And, he's admitted it on the record. He was wrong not to appeal and at least keep his legal options open.

If they do, I expect they will also lower the penalty that was imposed on the Rats for tampering as well.

It is certainly within your rights to waive your integrity for any reason.

Actually, we don't know that. We know an appeal wasn't going to get anywhere. So then you're left with a lawsuit. No one knows what the ramifications of that would be since the owners have as part of their by laws or constitution or whatever that no owner can sue the league. Whether or not there would be retribution against the team in the face of Kraft suing the league and what form that retribution might take is unknown.
 
perhaps kraft should write hunt a sternly worded letter to drop the appeal and think about the 32 first.
