It is perfectly reasonable to go after the picks now. Just needs to word it delicately.All he needs to say is, "In light of the US Federal Government validating what we believed which was that the process the NFL followed in determining our team's involvement and subsequent guilt in deflating footballs was faulty and lacked sufficient evidence, I have decided to explore our options in recouping our draft picks.".

Disagree. Based on the Wells Report, Kraft said, "we disagree with the punishment, but we'll take it." Berman's decision does not take issue with ANY factual findings of the Wells Report, including that Patriot employees more likely than not deflated balls. Kraft screwed the pooch, but he can't make it any better by going after the picks now. That ship has long since sailed.
 
The funny thing is, they might have been right. Winning this case in front of Doty would've been a walk in the park.

But the NFL's case was such garbage that they still lost, and screwed themselves over in a huge way in the process.


Thank God the NFL didn't drop their settlement offer to 1 game. He might have taken it.

Curran spoke with someone "very high in the organization," who said looking to overturn those penalties is not something they've yet discussed. However, Curran said the likelihood was "extremely remote" because of Patriots owner Robert Kraft's decision in May not to fight the discipline.

"To go back on that now would really cast Robert Kraft as someone going back on his word," said Curran. "As a result, it's highly, highly, highly unlikely that the Patriots would try to recoup those draft picks.

"However, there is an extreme feeling of validation (in the Patriots' organization) right now."

For the Pats and their fans: That is a real shame. :(

For the Krafts: if true, that is shameful.

This is a different angle. Bob is not talking about the Wells Report. He is citing the process the league used to determine guilt of his franchise. It has been brought to light that their process in determining punishment is absurd. A Federal Judge has determined it to be absurd and arbitrary.

Bob needs to stump the message to the other owners more forcefully...."This can happen to you too." These owners are asleep at the wheel. Maybe he can wake them up.

There was no determination that the franchise was guilty. The were punished without a guilty finding. They were, in fact, punished despite being completely exonerated.

Still, Kraft caved in the name of money. He's not coming back from that.

First of all, you need to understand that Berman could not rule on the evidence. With that in mind, you need to actually read Berman's decision because he clearly DID take issue with the findings of the Wells report. He used words like "supposedly" and "allegedly" to point out that he didn't agree with them. Furthermore, Berman outright questioned their validity in open court and used those questions specifically in his decision..

Kraft may have hurt himself by capitulating early, but with the information that has since come out on how the NFL railroaded Brady and the Patriots, any lawyer worth his weight would be able to get those picks back..

This seems more improbable then not. I believe Kraft is concerned with damaging the NFL brand. You could make a case by putting this "Owners against Patriots gate" in the rear view mirror that Kraft will make more money in long term by doing nothing. (More NFL fans=more money) I do not believe Kraft cares about the extra immediate money as evidence by his speech earlier this year. (Taking the penalties instead of fighting thinking it would help Brady) I would think he would take the high road once again. (It makes the most sense from a money/moral stance)
 
I hate to be a wet blanket, BUT, I'm currently watching the NFLN's reporting on the breaking news, and the 2 items that I'm not hearing is, "clearly Brady and the Pats didn't do anything in the first place", and "the League's malicious prosecution was one of the key reasons for the win."

Basically all I'm hearing is Rappaport telling us that this is all about the issues with the policies and procedure (Pash not being available) (files not being available) (no prior notice) etc. Others are talking about the importance of what it means to the NFLPA. But NO one has had the guts to just say that the Pats didn't do anything and its all coming out. So as of this moment its, "Breaking news, Brady beat the rap". Even in the Judge's comments he says that no player probably knew about any deflation, BUT he doesn't say its unlikely anything happened at all. In fact with the words I saw, he IMPLIES, that something actually did, but just Brady can't be proven to know about it.

Now maybe I'm being too invested in the concept that this has to go to a defamation case for the NFL to get fully exposed. This IS great news, but only as far as it goes. It solves the immediate problem, but not the long term one about Tom's legacy and the Pats as serial cheaters.

Since the league is being totally stupid and appealing this, I would agree that an arbitration hearing would be pointless.

He may need to wait to see what happens with the appeal- then try to get some support for the recoupment of the picks from the other owners which I do realize is slim to none because they are sick of the Pats kicking their asses every year.

Right, that's why he never goes to any big games. Jerk. Also, nice of him to be in SF so he can turn the attention to the next Super Bowl, and forget all about last year's. More disrespect from the league to the champs.
