Have said for a while now BB was their intended target, #12 is collateral damage.. but when they found out BB liked to use crappy footballs for practice, that plan hit the shytter real quick.

It started when Kensil was foaming at the mouth on the Pats sidelines during the Indy game, "We f... ing got you now"!!!!!

Seems so surreal.

This whole thing was started by the Colts and carried out by Kensil.

The.Whole.Thing.

If DEN beats Indy this doesn't happen
 
Here's the thing. If Berman wants to rule for the NFL* because he has to because of the CBA, then why is he wasting everyone's time with facts? Do we really want to believe he's just throwing out this stuff that will have no actual bearing on how he decides just to pressure a settlement?

Assuming your premise, perhaps he feels that this is a miscarriage of justice that he cannot right under the law. In that case, he can poke holes in the basis for the sanctions and get the NFL on record doing violence to Tom Brady's public image so that Brady has a more solid basis for a defamation suit, which could succeed where the NFLPA suit cannot.

I don't believe this, personally - but it is a possibility.

In this 7 month total immersion into equipment issues, the real story it is completely surreal, it is as though the NFL has morphed into a parallel universe, where right is left and up is down and wrong is right.

Goodell, Kensil and their hired guns are completely focused on BB; they change NFL rules, they disrupt their preparations, suspend star players, they take away draft picks and still they win...

That seemed to be the road Berman was going down yesterday.

Is the Wells report a solid foundation to support the suspension?

Hate to read tea leaves but seemed he was more interested yesterday in justice and not due process.

Yes, the presence of that word "reasonably" should matter. It absolutely should not be possible for Goodell just to suspend players arbitrarily on a hunch, which appears to be what he did here.

Since there is a standard of "reasonable" for the court to consider, I don't think the court is going to be impressed with responses like "the report doesn't have to be independent" and "under the CBA, the commissioner can just do what he wants."
 
Given press conferences by BB, I could guess his tex ting history. k, k, kk, k...
I would imagine Thanksgiving would be something like this at the Belichick household:

Guest 1: Bill, could you pass the salt?

Kessler brings in McNally and JJ and they explain the reasons for the text messages and state Brady never told them to do anything illegal with those footballs.

People with names that rhyme with ash, fall to the floor in fetal positions sobbing uncontrollably, " But ....the ....C BA...the CBA"

Can't wait to see Kessler's new appeal this Friday.
I'm guessing it will includes lots of statements made by Pash et al on Wed that contradict the Wells report and other court filings re independence, evidence and a nexus between McNally/Jastrewski and Brady or lack thereof...

I don't think they settle before Wed, if only to give Kessler a chance to cross examine Goodell......
and yes I realize that means Pash and Reisner (?) get to question Brady but it seems that the NFL has more to hide and a less solid argument.

With the stipulation that each member is pulled from the room to make sure nobody hears each others stories (though you'd think they'd have the script nailed by now, but not sure they are that smart) and asks them how this whole thing got started and who knew what and when (Fact finding on the sting, ...)

Make-believe aside, Judge Berman might want Goodell to walk him through his process and how he concluded that he interpreted each fact as he arrived at his decision. most importantly, how he set aside any prior knowledge to act in a fair and impartial manner. you know be buddy buddy from 1 judge to another.

And the Pats continue to win. If the Pats don't have a #1 pick stolen back in 2008, maybe they have another Superbowl win or two.

And ask each one how much air do they believe McNally released from those footballs. I still believe Roger does not know how much or is still under the impression it was in the vicinity of 2 psi when the Wells report implies 0.3.

I would love it if somebody reported that the original story of 2 psi was actually 0.3.

From way outside looking in with no legal background, I had the impression that is a response to something that happened either in chambers or in the open courtroom. Looking forward to what additional shots Kessler will fire.

Again no legal background, but it seems the union has a strong argument that Badsmell's judgement did not follow law of shop and do not feel negative about the outcome.
