Article 46 says that it goes to an arbitrator, but that, at any time, the Commissioner may decide to be the arbitrator. I don't believe any commissioner, previously, actually abused this the way Goodell has.

Actually, 46 references a Hearing Officer, and that the commissioner may appoint himself as Hearing Officer in specific situations.

Just pointing out a possible technicality that NFL may use to counter the obvious bias of the commissioner - he's not an arbitrator, he's a Hearing Officer.

You would think not. Yet, still I don't see the NFL caving unless it's one or two games. If Brady accepts guilt it's perjury. I would hope Judge Berman would say to the NFL, either you vacate it or I will. It's up to you. I'll also state in my ruling that I offered you the opportunity to do so.

We don't know. Can the judge continue to grill both sides in there right now? If so the tables may be turning on Brady or the NFL* may be getting slammed even more. We just don't know.
 
You are incorrect because of exactly what I said. The procedurals don't make a damn bit of difference if there is nothing to proceed against.. And it was PLAINLY clear in his questioning that he doesn't believe there was any evidence for the procedure to move forward. Hence his question.

And your categorically wrong. Berman did NOT say that it was "inexplicable that Brady didn't notice the deflation. What he said was, "Would be hard to imagine a QB…(not knowing a ball is deflated). He’s the one who throws the ball." What Berman failed to take into consideration is how numb a player's hand gets and the fact that players have said the balls get hard in the cold. That would off-set attempts to feel any difference in ball pressure.. Not to mention less than a lb in most cases..

So, you chose to ignore the fact that Berman followed up directly with "Turns out Mr. Brady did better with higher inflated balls than underinflated balls. You might say he got no competitive advantage" The unsaid thing here is "why would Brady want something that didn't give him a competitive advantage?"..

A Federal Judge is the only person to make Goody submit. With that said I don't think he would do that with TB12 in the room.
 
I'm getting tired of seeing these statistics repeated over and over. What does it say about the NFL if unions in general lose more than 95% of cases brought to court, yet the NFL is 0 for 4? I get that the NFL only provides a small data set, but why must "legal experts" assume that all cases brought to court are equivalent?

Because I think they don't realize that in the other cases the companies being sued did everything to the letter of their CBA and what the law says they could do and most of those cases are employees just deciding to go to court because a true neutral arbitrator ruled against them.

With the nfl* ****dell overreaches on punishment, then refuses to bring in a true neutral arbitrator. The one time he did was Barbara Jones and she ruled against him. The other arbitrators like Harold Henderson clearly take orders from ****dell. Hardy's reduction was a clear thank you to Jerry Jones for standing behind him on this. Anways, he overreaches, upholds it and does it because he thinks the cba allows him to do whatever
 
Think Berman would like to finish this today . He proved that godell was not a fair arb. If the NFL doesn't make major concessions they are screwed. He doesn't want to deal with framegate any longer then he needs to. And if NFL doesn't start softening up he will embarrass them more next wedns .

Even if Berman is considering the actual substance of the Wells Report (which many of us lawyer's did not think he would do based on this being a CBA process issue), if he does consider it, it doesn't matter whether he thinks Brady is lying or not, or whether Brady is lying or not. All that matters is whether there is evidence that Brady actually committed the act, which I posit there isn't evidence of.

For the point of that article, a hearing officer IS an arbitrator.. And the hearing officer is supposed to be determined with consultation from the Executive Director of the NFLPA. Just like the E.D. is also supposed to be consulted in advance of any penalty being assigned.

Gee, who would have thought that a company should have a CEO and executives that know what they're doing?
 
How grimy can Kravitz get that he is calling out the integrity of a federal Judge because he doesn't seemingly support his opinion. Wow Kravitz.
The one thing I'll say about judges is that in general, they are dead serious about their job and the law. Lawyers are slimy and try to spin the law. Judges are extremely serious about the law and how their decisions affect the future of law.

I don't know what way this goes because the CBA gives Goodell broad powers to be a **** but I do know the judge will do his best to minimize his personal bias and try to do what is in the best interest of the law.

But with how gung ho nash and ****dell were this weekend about nflpa not having a case and them not backing down from 4 games, the things Berman questioned them about today and how Kessler came into court conceding the cell phone thing. My guess would be it isn't good for the nfl.

What is absurd is your continuation with some ridiculous idea that Berman's questions didn't show just how flimsy the NFL's case was. Go waste someone else's time and not ours.
