Actually, If I'm correct Rex and the Jets who'd have a shot at signing him before we do. He could agree not to play (which would probably hurt him more than help him) but even if he didn't play it would probably still be beneficial for the Rex to pick him up in order to keep him from the Pats. Why would he want to give the Pats Moss, Welker, Branch, Hernandez, Ellderman, and that little guy they gave away named Danny Woodhead?? Picking up Moss, whether he plays or not, might be a good investment for the Jets or Miami..

On the flip-side, picking up a player that doesn't want to play for your team, especially a high profile and vocal player like Moss could be a distraction. So, although it would be a competitive move for the Jets or Miami, it might not be worth it...
