Just to reiterate, on the second to last page Berman declines to reach a determination on a bunch of claims, including evident partiality, because he didn't need to after agreeing with everything else that Brady argued:

I know some people earlier were worried that the decision had ruled that Goodell was impartial, but thankfully it didn't do that. Didn't rule either way, which is kind of unfortunate because I would love to see Goodell get stuck with that as a matter of precedent. But declining to reach a conclusion is a whole lot better than reaching the wrong one.
I believe the fact that the Judge listed these other grounds that he didn't even have to reach is good for Brady. He's subtly setting up a few things: 1) telling the NFL (and perhaps further appellate judges) the NFL could have lost even worse; 2) in the unlikely event that Berman is overturned on appeal, that there are other issues that should come back to him on remand (rather than just vacating Berman's award). It's subtle legal maneuvering on the part of the Judge, IMO, but it's favorable to Brady.

ESPN is stating that Hardy's likely to appeal his own suspension in court now that the Brady decision is out.

I really hope this opens the floodgates of every player who gets suspended on shady grounds going directly to court, exposing Goodell as a fraud, and running up the score against him in court.

Just heard Shefter (I think) mention that Sean Peyton could look into how his case was handled now that a lot of the "behind the scenes" activity has been exposed.

If I were the 2nd Circuit, I'd tell the NFL to pound salt if they asked for an expedited appeal: THIS IS A DUMB CASE

NFL spokesman said unsure at this point if league will request 2nd Circuit to expedite appeal

"Mike, Brady still should have admitted blame and taken the two games." Tony Maseratti (my prediction he will say when they start the show)

The turning point of this whole game was when the nfl filed it in NY AND judge berman decided to make the transcripts public. Without that it would been even hard to turn some public opinion.

I think technically, Goodell was right. I read that it was basically "are you going to suspend them or will we" and the Pats figured they might as well. Nowhere in there is a request by the league to suspend them, although it was certainly implied.

Actually, the letter from Vincent to the Patriots stated that the Patriots had to suspend them and that their suspensions could only be lifted by Vincent and then the two could not work in their previous jobs..

There are very few TV law analysts I can listen to at all on most legal matters. (One reason I started writing).

@StephStradley Roger Cossack blathering ruling is wrong, nothing about fairness in CBA

Yeah, Schefter has been saying that on ESPN. I don't think he has much recourse, though. Unlike players, coaches aren't protected by a CBA. That's why we really dodged a bullet by avoiding a Belichick suspension. It would have been ridiculous and a miscarriage of justice, but Belichick would have had little/no recourse.

Is there a link? Can the Patriots now appeal this?

I thought the suspensions were in place prior to Vincent's letter.

Goodell needs to be examined for CTE.

Oh guarantee the F&M narrative is "he's still guilty".

I'm pretty sure the coaches have a union. I say this because it came out that Belichick isn't a part of it and that was the reason his name doesn't appear in the EA NFL games.. Now, don't know if they have a CBA or not, but I would think that there is some sort of agreement. However, if I am wrong on their having a union, I will gladly stand corrected..

No. "Face saving" is an imaginary construct. It is bad precedent. They hope overturned but could make import worse.

@StephStradley but dont you think they HAVE to appeal to sort of save face as it were?

Just heard on the radio. Judge berman overturns the 4 game suspension according to the AP.

THANK YOU ROB!

Get Those Chants Ready For Opening Banner Night!

Won't be surprised to see Brady tonite vs Giants.

I said in another thread, my prediction is Mazz will say that Brady should have admitted guilt and taken a two game suspension.
