The return of our draft pick would also work as well for the NFL office being dumbasses.

How about throwing in an extra first or second, because they really blew this one.. I am sure no one would protest...
 
So, the League broke it's own rules. They should fine Goodell $500,000 and suspend him for a few weeks.

And give us back our first rounder.
 
Are the contents of the tape good or bad for the Pats?
The contents were generally good because the tape was fairly benign. Just a look at the signs being sent in, flash to the scoreboard for down and distance and repeat.
 
What are the reports on how the tape was confiscated? Was there a gap between when the camera man was detained and when it was seized by NFL security?

My concern here is that the Patriots leaked it. How are we so sure they did not get a copy? Might they not have asked to see it before they prepared their response? I imagine they might have.

There was no indication whatsoever that the Patriots ever had custody, let alone sole custody, once the camera man was intercepted.

There is no evidence of this at all. Every piece of evidence presented by both the Jets and the League claims that the uncopied tape was seized on the spot, sealed and sent directly to the commissioner. Who would have allowed the pats to make a copy? The assumption would have been that they knew what was being taped, since they did not deny it, and there was no need for them to see it.

It does look like teh Jets are the ones here who leaked it...PFW justtalked about it and one of them stated that he was sure the Jets did..saying he really couldn't say more...Hmmmm So what is Goodell going to do to the Jets?? I really wonder!!
 
I'm still not clear on what Fox did with the tape and why this is a story.

Either the Jets leaked it because it is incriminating or the Pats did because its not.

Is Fox showing this video? What statements has Glazer made about it?

The Jets had a copy in their posession origianlly - it was 8 minutes long... not a lot of time needed to copy it.

But given the fact that Goodell's wife works for Fox, I'm not ruling him out either.
 
The story has been that Estrella was surrounded by Jets security, Pats security, some NJ state troopers, and so on. Eventually, he gave the tape straight to NFL security.

If that's true, I don't know how the Jets could have been guilty of the leak any more than the Pats could be.

Yeah, that's what I thought too. Unless there was a delay in the time that it took NFL security to get it, I would think it would be more likely the Patriots would have received it in order to respond to the charges than it would be that the Jets found a way to make a copy.

Alternatively, I suppose it is possible that the leaked tape is not actually the seized tape. The only actual information we have that they are the same is what Glazer has said, but there's no way to know.

No it gave the Pats a bit of motivation for the entire season and more each week there is more fuel people are adding to the fire. Cheating goes on throughout the league. Its not something new.

It was shot from the Pats sideline and it's pretty obvious the footage was from the game. It was either a second camera, or the original. Even if it was the second, the result is still.... someone shot the signals. Let's just accept that it was the real footage. lol

The other explanation is that Estrella made more than one tape during the first quarter. I'm not saying that what Glazer showed wasn't a tape that was made by Estrella during the game, but just that it might not have been the one taken out of the camera and seized.

I think, obviously, the most likely explanation is that the tape was seized on the spot and that it somehow got leaked after the NFL had it.

But the notion that the jets snuck a copy before the NFL got it and then leaked it to Fox seems to me much less likely than the possibility that Estrella (or someone) made more than one tape.

This is almost certain a "fair use," which is a defense to a copyright violation. Plus, government action -- which includes federal statutes such as the copyright act -- cannot impinge on the press's freedom to report on matters pertinent to public figures or newsworthy events.

The use Fox made of the tape is almost certainly a statutory fair use, and even if it weren't, it would almost certainly violate the 1st Amendment to try to restrain them from using it.

I'm actually not even certain the NFL owns the copyright, by the way, in what was shown on the tape. It's not the contest itself.

Anyway, Fox has broad first amendment protection here. They similarly cannot be required to disclose their source or even be ordered to produce the tape they have except in very compelling circumstances.

What realy happened is.

Estrela was filming cheer leaders for BBs private enjoyment, the Jets security took the camera and tape from him, then when no one was looking Mangini switched it with a tape that the Ryan O'heir (Jet employee) had made. then they hand over the camera and tape to NFL security hopeing that BB would get suspended for 6 years.

Then as the story started to wain, Mangini leaked the phony tape to keep BB on the hot seat hopeing he would get suspended for 6 years. Mangini is behind all of this, not to mention the $500,000 that Fox gave Mangini for leaking the tape to them.

This is just the tip of the iceberg. Mangini has BB on film comeing out of a Vegas hotel room with a gun followed by OJ and his crew. We should be seeing this film on Fox very soon.
