Not a fan of the second season of Better Call Kessler so far...

I'm assuming he knows the judges selected better than most people. He may have known he was screwed by the draw of the judges which explains his comment about the judges being persuaded by their own version of the facts. Frankly, it sounds like their familiarity with the case is based more upon what they read in the NY Post vs. what's in the legal briefs and record.
 
Did these judges even grow up in New York? Did they go to school in New York? I doubt it. But obviously they must be Jets fans right?

Uh...well Chin went to high school at Stuyvesant in NYC and later attended Princeton University , in the HEART of Jet fan land.

His father, Barrington Parker was a federal judge in D.C. "On September 15, 1969, Parker was nominated by President Richard M. Nixon to a seat on the United States District Court for the District of Columbia vacated by Joseph C. McGarraghy."..coincidentally, at that very time Charles Goodell was in his third term as US Senator from NY, and one of many who voiced support for Parker's judgeship to President Nixon.

Myself, as a patriots fan,I would have much preferred the Minnesota venue when all this complete bullshyt started. Goodell used millions of dollars to get the venue in NYC where HIS influence and that of 345 Park Avenue is at its zenith.It's quite proper and just that Patriots fans question this whole trumped up 25 million dollar charade. If you find that hard to stomach too effin' bad.Newsflash, this ISN'T a Transformers cartoon or a Star Wars novel...there are serious adult human beings here asking serious, cogent questions about this whole sordid NFL circus.
 
The Clemente half has more softballs than a, um...softball factory. How the hell were we told for 6 months that none of the actual case would come up and then BANG they are essentially retrying the case from the standpoint that Brady is very very guilty? Honestly, how is that fair? This is our justice system? Freaking joke, man.

I'm surprised they are waiting. I don't know why they didn't just say "Overturned, Mr Brady is a cheater". Because they are all thinking it, it jumps off the pages and quotes.

the offseason from hell with tb12 suspended. at least this time we'll have months to deal with it.

all of the preseason/summer nfl news will be very annoying though. the media will bang the brady is suspended drum down our throats every day.
 
It really does blow that after hearing the actual facts about the case would not be part of this, than the judges make it part of it, allow the nfl to make their case, but not let Bradys team explain /defend these things (at least not fully ) for things they brought up! And to top it off, less than a half hour is all they got and their making a decision off of that, just really blows. I'd feel better if they had let Kessler make more of his case like they did the NFL.
 
Won't that help Brady's team appeal the appeal? One side got to retry their case, one side was *****ed at for 15 minutes. Kessler started talking IGL and got shushed. There has to be some kind of recourse for the NFLPA to take, right?

Who knows but I will say if they rule to overturn Berman and then cite the evidence as to why they did then I think it will absolutely get heard. They are not there to judge whether they think Brady did it. They are there to rule on Berman's decision which his reasons were

-Inadequate notice
-Brady was denied the opportunity to examine the co-lead investigator
-****dell improperly denied Brady equal access to investigative files


Maybe the notice gets overturned but if the other two do then i'm definitely calling bias.. But even if one of those reasons is upheld Brady wins..
 
Yes, Brady would win if one of the other two went his way, but it was only "inadequate notice" that stopped this whole thing. The others would require a rehearing.

I don't think that's a bad thing, by the way. I would happily accept a rehearing with a neutral arbitrator.

Not everyone is as obsessed as we with (a) sports, (b) the NFL and (c) a particular team in the NFL as we are. It's highly unlikely that any of these judges have any emotional involvement in the Jets or any sports team.

Interesting that in an official document they mention Tom Brady instead of Thomas and his full name.

The NFLPA's own filing with the appellate court, filed by and on behalf of Brady, lists him as:
"TOM BRADY, COUNTER-CLAIMANT-APPELLEE"

Disagree completely, the New York papers were more honest than the brief the NFL filed with the appeals court. Clement lied to the court and appears to be getting away with it.
 
Well, Chin was born in Hong Kong but, other than that, I think all three judges live, work, and were educated in or near NYC. I don't know how much experience you have with NYC but (1) pretty much everyone who lives/works there is batsh*t crazy narcissist; (2) they are seething with jealous resentment toward Boston sports teams and (3) outside of maybe Chicago and DC, NYC is second to none when comes to government corruption.
I've lived in Manhattan for 20 years and am active in political and other circles. What is your history with the city?

Yeah, I expect the last times he was referred to as "Thomas Edward Patrick Brady, Jr.," were on his Birth, Baptismal and Marriage Certificates. I'd be willing to bet that his Patriots' contracts are in the name of "Tom Brady."
 
Hmmm. Hopefully Judge Chin buys Kessler's explanation here.

 


Feels like this exchange is critical to Judge Chin's opinion.
 
It's funny, at drill weekend they were discussing a case where they were disciplining someone and said the official standard is "more probable than not" to determine if someone is guilty of an infraction :rolleyes:.
