I'm not criticizing you but could you please explain your rational?

Sure, but an example is probably the easiest way to do that. Just take a look at the quote you panicked about. Read it in 4 ways, while placing yourself in the judges' position, and then post your take on that quote under each circumstance:

1.) You don't know about the gas law
2.) You know about the gas law and don't buy it as a defense in this case
3.) You know about the gas law and aren't yet sure enough about it to deal with it specifically
4.) You know about the gas law, buy that defense, but don't want to bother with it in court

I feel like I should join in the gloom and doom and outrage but I just…can't. I am fully fatigued by this whole thing and now that its the offseason, I am realizing how peaceful an NFL-less existence is. Seriously, guys. There's absolutely nothing we can do. No need to kill your blood pressure over this.

My take was that they are aware of it and don't buy it as a defense in this case. How else could Chin come to the conclusion that the evidence of ball tampering was convincing if not overwhelming if he put any stock into it?

Im trying to figure out why some of you aren't alarmed at Kessler's quote.

Brady's entire case is that the arbitrator deliberately and with malice disregarded the facts.

If the judges believe that this didn't happen, then Brady loses.

The only reason Berman ruled against the arbitrator's (ahem) discretion is because he believed the arbitrator was biased and was not giving the facts an adequate assessment.

If someone turns around and thinks the facts overwhelmingly show tampering, then you have to defer to the arbitrator.
That is simply not true.

Bermans ruling was based on
-Lack of notice
-Not being able to question Pash
-Not being able to review the Wells notes

Nothing about Berman's ruling (other than your perception of what he thought) had anything to do with Goodell being biased or tampering occurring or not.
 
Strange judge says he don't want to hear about Ideal Gas Law but does the phone. Both are one and the same they surely both should be discussed or neither.

How dumb are your judges in the US.. what an embarrassment.

Regarding Berman, I seem to remember the first day was pretty rough too, on both sides. So I don't think all is lost really
 
The way I look at it is this, no matter WHAT happens, the NFL lawyers, IN A COURT OF LAW, admitted they HAVE NO PROOF Brady did anything wrong. Repeat, they admit in a cours of law, that they HAVE NO PROOF Brady did anything wrong. You can always bring that up to any Neanderthal that celebrates if Brady loses THIS ruling. I don't care if he has to serve the suspension, it is in black and white, they admitted to a judge they have no proof. I know it's not fair if Brady winds up serving his suspension, they admitted they have no proof, and that's the bottom line as far as I'm concerned.

Football being a complete farce I can live with. The court system being a complete farce is a little bit harder to accept.:eek:

It's not strange at all.
Whether the balls were deflated or not has nothing to do with this appeal. It is only about Berman's ruling, which was only about the arbitration process.
The phone matters because it was introduced DURING the arbitration hearing.

Chin and Parker turned out to be a couple of nit-wits who asked dumb questions. Legal "experts" predict the worst. This board sh*ts a chicken. That about sums it up.
 
Reading the tweets:
The NFL tough questions came first.
"How can the NFL justify these penalties based on new factual findings?"
"Shouldn't Brady have been given notice regarding destruction of the cell phone?"
"Why is the inflation level so important? Is there any advantage?"

Reading this thread it appears as though Brady's side was grilled first, and then a short question for the NFL. The NFL faced questioning first - maybe not as tough, but they were challenged.

I know there are a number of experienced lawyers on this site. But I have watched many seasons of Law & Order. Anytime Jack McCoy faced an appellate court, the judges asked both sides challenging questions.

IIRC Berman specifically noted that he didn't consider Goodell's bias but if the case was sent back to him on appeal then he would rule on it.. It could be a poison pill allowing Brady to eventually previal in the event Berman's ruling was overturned.

both sides were grilled. kessler was grilled more than NFL's lawyer. legal experts say brady is going to lose either 2-1 or 3-0 based on the questioning.
