Cmon Kessler. Why acknowledge the idea that he did deflate the balls?!?
 
Not liking Kesslers answers, I assume he is going somewhere with it. Why say the balls were deflated cause of science ? Unless that would poison settlement talks

Oh, come on, Kessler. That is seriously weak.
 
I don't think the NFL's lawyers (my former law firm) were ready to speak to the merits of the Wells Report.
If they weren't, then they are stupid and need to be fired.. OH WAIT.. The fans already established that a long time ago.. LOL
 
"It is conceivable" = "It is possible," not "This is what happened."

I am nervous, though.

ETA: Berman could be looking at the "worst case scenario" for Brady.
 
Why say this? ? Why not just go with no legal deflation occured?
Well the more alternative and logical possibilities there are, the less likely the NFL's version of events occurred.
 
Seems like Brady is going to win in court. If the NFL needs to convince Judge Berman that Brady did something wrong, their case is DOA.

"Mr. Nash, what is your evidence that Tom Brady instructed Mr. McNally to deflate footballs?"

"Well, Mr. Brady destroyed his cell phone."

"That is not evidence that Mr. Brady instructed anyone to deflate footballs. Anything else."

"Well, Mr. Brady spoke to and texted Mr. Jastremski after the AFCCG."

"So he told them to deflate the footballs after they deflated them?!? Anything else?"

"Mr. Brady gave Mr. McNally free shoes."

"Is there any proof that he did that as a quid pro quo to deflating footballs?"

"No, but...."

"Anything else?"

"Mr. McNally called Mr. Jastremski Dorito Doink."

"I think we are done here."

Are those actually quotes from Berman?

Oh, come on, Kessler. That is seriously weak.

Might be saving the big guns in case they are needed later. They don't need to pull that out at this point because they are already up two touchdowns.

I would guess that he's leading to "even if you accept that the deflation happened as the NFL assumes, you still have little basis to assume that Brady was in on it". Ties back into Berman's argument that you have to show that Brady intended to be part of a conspiracy before you can punish him for it.

The fan in me wants him to lead with "there's no good evidence that deflation occurred in the first place", but there's a reason why Kessler gets paid a ton to do this and I'm just some guy on the internet.
