NFL: No Violation by Favre; $50k fine

This thread is a perfect example of recreational outrage.

If my girlfriend sends me naked pictures, can I get her arrested/fired for exposing herself to me? Why not? If she sees me walking out of the shower naked, can she get me arrested for exposure?

There is nothing saying that Sterger can't still sue if she doesn't think the punishment was adequate. She said she wouldn't sue if the NFL disciplined Favre.
The deadline for Sterger to file a suit was yesterday. There is zero coincidence with that fact and the timing of today's announcement by the NFL.
 
I guess I must have missed the part where Favre and Sterger were in a boyfriend-girlfriend relationship.

Having worked in Fortune 500 companies, sexual harassment is a huge issue for any organization that makes a lot of money. It extends beyond an employee and their direct supervisor; it applies in particular to any person at one level in the company hierarchy being harassed in any manner by any person at a higher level in the organization.

Favre, making $12 million per year and seen as the face of the franchise, would certainly qualify as being in a position to make others in the organization feel intimidated and fearful of retaliation if reported.

mee thinks SanAngeloState may have been involved in some sexting and is only now worrying about potential consequences.
 
I think it would be fairly easy to trace the photos back to Favre's phone.

However, he has already denied that he sent her photos and maybe he told the NFL investigators that he didn't send it but could be that he doesn't remember (as he was so drunk at the time). Anyway, how do you prove it is him in the photo? He or one of his lawyers could argue that he left his phone by mistake in the locker room and someone might have sent these as a prank.

In any case, difficult to prove and the NFL is not a court of inquiry. Favre may have told them to f*** off ... no evidence of any value and they levied the fine for "lack of cooperation".
 
i wonder if BB wouldve "not cooperated" during cameragate issue if it was just going to result in a lesser punishment.

Based on what happened with 49ers and tampering, the Broncos and Scarnecchia, and the Jets and Alosi, the best tactic appears to be denying any wrongdoing. Or claiming that the person who committed the act was acting on their own.

Belichick should have said he never told Estrella to do anything. Admitting you did something wrong seems to only incur a harsher punishment.

I think the difficultly in proving the photos came from his phone is that the NFL never tried to trace them. This has been a cover up all the way.
 
Still totally pissed off by this but I have managed to find some irony: Favre is beloved by the media for his cooperation and yet fined for being uncooperative.

If he truly had no relationship with this woman, they were perfect or near perfect strangers and he did this, well, I find that hard to believe.

This woman is assumed to be purer than the driven snow. For all you know, she asked him to send her pictures. Maybe she joked about it with him and he actually did it. A woman joking with a married man about something sexual? NO WAY! That could never happen. Jenn Sterger needs your protection! Only you can defend her innocence!

No one basically knows what happened, except those two and apparently they aren't saying much.

First, as pointed out previously, they were not in a relationship. I think there are plenty of shades of gray between perfect strangers and being in a relationship. At any given time there are at least dozens, if not hundreds of women that you, I, or anyone else here knows well enough to have a conversation with but at the same time are not in a relationship with; not sure why you paint it as an either/or black or white situation: stranger or relationship with no in between. I don't know about you or anyone else, but I'm not sexting any of those people I know in that gray area - especially if they are co-workers, clients, customers or vendors of mine.

Nobody is saying she is pure as the driven snow, I don't know why you would imply that. If she was joking around and Favre misunderstood, then why haven't one or the other said that this was the case, and that's what happened? Is it okay to do or say anything to a co-worker if they get a boob job or dress provocatively where you work?

This isn't about defending Sterger, that has nothing to do with it; it's about poor decision making by Favre and a subsequent hypocritical coverup by the NFL.

True, nobody knows for sure except those two. But consider this: if she was in it for the money, why didn't she sue? Why hasn't she done any tell-all interviews for a fee? Remember it was Deadspin, not her that broke the story - and that she was allegedly looking for a suspension and admission of guilt, not a payoff.

Again we will see posts stating that the NFL is not like Fortune 500 companies and that the normal harrassment laws do not apply, at least to face of the franchise QBs. :rolleyes:

he sucks, it almost seems like he is trying to destroy the nfl. either that or he has no clue what he is doing. either way he is in a position he shouldn't be in.

It's called a statute of limitations. It was established so a person can't file a lawsuit over something that happened 30 years ago when it'd be harder to prove or disprove. The length of time varies depending on the complaint.

That's a very general, uninformed answer to your question. Anyone else have more details/knowledge?

Statute of limitations in the state of New Jersey is two years from when the incident occurred.

So why the delay? We have a theory. With Sterger’s camp claiming that she won’t sue if Favre is found responsible for wrongdoing, delaying a finding of no wrongdoing until after the deadline for filing a lawsuit has passed prevents a viable lawsuit from being filed.

Sterger’s lawyer, Joseph Conway, told PFT earlier this month that the last communication between Favre and Sterger while both were employed by the Jets occurred on December 28, 2008. In New Jersey, the statute of limitations for filing sexual harassment claims is two years. Thus, the deadline for filing a sexual harassment claim under New Jersey law comes and goes early next week.

As a result, we now think a decision will come on December 29 or 30. And that the decision will be that no discipline will be imposed on Favre because it’s too difficult in this case for the league to determine whether sexual harassment as defined by the law occurred, and that the situation would better be resolved in a court of law, where Favre’s lawyers would have a full and fair opportunity to develop evidence regarding the possibility that Sterger wasn’t offended by any of the alleged communications.

Which may never happen if a lawsuit isn’t filed by December 28, 2010.

Right, there are plenty of shades of gray. That's my point. Where were they on the "shades of gray scale"? Maybe sexual banter and explicit e-mails was the norm between them. If someone dresses provacatively? Well again, I wouldn't say anything to a stranger, but I might to someone with whom I was very friendly.

Maybe she wasn't offended at all. Maybe she thought it was hilarious and is just panning for gold now that her career is a little slow.

Oh, and as to "why didn't she sue"? Maybe because that would require discovery and she doesn't want to go there? Maybe she wants to play the virginal victim card and make some money in some other venue. Look at all the guys on this forum ready to go to war for her when they know nothing.
