First that kind of blows my mind, and I worry about what impact that tidbit might have in appeal.
Then off course since I haven't read the decision myself (and I doubt Judy did either), I love if someone more proactive will confirm or deny this surprising remark.
BTW- Judy did say this was the only positive for the NFL. The rest was totally in favor of the NFLPA
Agreed - it's VERY HARD to get an arbitration award overturned at the federal level, even if things weren't perfect at the arbitration hearing itself. The fact that this arbitration was overturned so soundly shows to those in the legal community that the NFL had NO CASE and needed to make themselves prosecutor, judge and jury to make this bogus thing stick. Many casual fans will unfortunately, just incorporate the "got off on a technicality" argument. I don't care though at this moment.You'll hear all about how Brady won because of "procedure", or a "technicality". What will be ignored by those stating such things is that the state of current U.S. law regarding arbitration rulings is such that you literally cannot win an appeal on just the facts.

I have to think the NFL will appeal this because this is such a horrible precedent for them. Of course, if they appeal and lose that's even worse...

Roger Goodell won't let Deflategate die. He has officially announced his decision to appeal Berman's ruling.
What does it say about the integrity of the game and the so called shield when the NFL's argument boils down to "we're not required to be fair"?This was the NFL's entire argument.
It may be ridiculous for Goodell to be the prosecutor AND the judge in this case, but that's what the CBA says he can do so tough crap.
It may be ridiculous for Goodell to be able to issue any penalty he wants for any infraction he wants, but that's what the CBA says he can do so tough crap.
It may be ridiculous for Goodell to flat-out lie about a player, but that's what the CBA says he can do so tough crap.
It may be ridiculous for Goodell to claim that an investigation is independent, backtrack on it when it's shown to clearly NOT be independent, but it doesn't really matter, because the CBA doesn't require it to be independent so tough crap.
It may be ridiculous for Goodell to punish a player for being "generally aware" of potential wrongdoing by others in the organization, but so what, the CBA allows him to do that so tough crap.
It may be ridiculous for Goodell/Wells to tell Brady they don't need his phone, and when Brady offers all kinds of electronic documentation Wells decides to not pursue that, but then when Brady doesn't turn over his phone they hit him with a penalty for that, but so what, the CBA allows him to do that so tough crap.

Goodell just issued a statement that's being read on ESPN right now. The NFL will appeal, because it's super important that he maintain the authority to protect the integrity of the game.
Mark Schlereth is absolutely blasting him on maintaining this point while refusing to abide by basic legal standards of discovery. Glad someone's finally making that point, although it's ridiculous that it took this long (and today's ruling) for people like him to start exercising common sense.
Of course, along with the "you know he did it, they just couldn't prove he did it" ********, ESPN said on my drive in that Berman explicitly ruled Goodell was impartial. I guess when you've been spinning as fast as they have, you need some time to wind down.
