I'm waiting for a take by a real lawyer on this Board, but it looks to me like he vacated primarily on Fairness and Notice, which should, in my layman's opinion, should make it hard to overturn on Appeal.

Otherwise, GOTTA LOVE IT:

For the reasons stated herein, the Management Council's motion to confirm the arbitration
award [ECF No.4] is denied and the Players Association's motion to vacate the arbitration
award [ECF No. 28] is granted.

Brady's four-game suspension is vacated, effective immediately.

The Clerk is respectfully requested to close cases 15 Civ. 5916 and 15 Civ. 5982.

I'm hoping for some detailed legal analysis of the ruling by noted legal expert Lester Munson. Should provide insight, nobody does it better, amirite?

I hate to be a wet blanket, BUT, I'm currently watching the NFLN's reporting on the breaking news, and the 2 items that I'm not hearing is, "clearly Brady and the Pats didn't do anything in the first place", and "the League's malicious prosecution was one of the key reasons for the win."

Basically all I'm hearing is Rappaport telling us that this is all about the issues with the policies and procedure (Pash not being available) (files not being available) (no prior notice) etc. Others are talking about the importance of what it means to the NFLPA. But NO one has had the guts to just say that the Pats didn't do anything and its all coming out. So as of this moment its, "Breaking news, Brady beat the rap". Even in the Judge's comments he says that no player probably knew about any deflation, BUT he doesn't say its unlikely anything happened at all. In fact with the words I saw, he IMPLIES, that something actually did, but just Brady can't be proven to know about it.

Now maybe I'm being too invested in the concept that this has to go to a defamation case for the NFL to get fully exposed. This IS great news, but only as far as it goes. It solves the immediate problem, but not the long term one about Tom's legacy and the Pats as serial cheaters.
 
When a team loses every game in a season, is it now considered an 0-for Goodell? I am so happy TB 12 is finally FREE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
 
Only problem for us is that Berman refused to comment on the NFLPA claims about the facts of the case. He never defended the Wells report, he just said that he accepted it because he had to as a consequence of arbitration. It would have been nice for him to tell the league/public that their investigation was a farce. I'm sure he didn't because it would have made the decision more vulnerable to appeal.

Don't get me wrong, I'll take it, but it definitely leaves room for people to claim Brady got off on a technicality but still cheated. Not that anything would have stopped that though, really.
