Tom Brady, NFLPA Granted 14-Day Extension To File Motion For Rehearing By Second Circuit Court

The most interesting aspect of this to me is whether or not the league changes their tune and offers Brady a deal he can't refuse rather than risk seeing this overturned. The league has so much to lose at this Point that they would be wise to do so. As things stand Goodells powers under article 46 are as broad as they can be, and that represents a big bargaining chip for them with the NFLPA, one they can horsetrade for the one thing the owners and Goodell want more than anything, and the one thing the players absolutely don't want----- an 18 game season. This will ultimately mean billions of dollars in future revenues for the owners and last time they tried the players said they would never go along with it. Goodell actually said in one of his victory lap interviews that if the union wanted to make a deal that reduced his powers the owners would be willing to make a deal and I think this was what he was referring to, he's no longer judge, jury, and executioner and the preseason gets cut to two games and regular season increased to 18. There would still be other issues to resolve to accomplish this but the owners would have gotten over their biggest hurdle, player approval. As it stands right now the owners have that bargaining chip, but if the Brady decision gets overturned again they will have lost their biggest chip. It will be interesting to see if there's a push to settle this, but I think ther owners will wait to see if en banc is granted first, if it is they may try to cut the deal to preserve the ruling.
How about 4 years in prison for Goodell and no fine suspension for Brady?
 
1. SCOTUS - a very long shot given no conflict between circuits (except if AP loses).

2. Yes - would need AP to win his case first or no chance of cert.

Chances are good because AP won his case in District Court. Hard to see the NFLPA losing both cases on appeal unless the 8th circuit intentionally waited to see what the 2nd Circuit was going to do.
 
The best ending for all, as you said, is the league to rescind the suspension and Brady to drop the appeal. It's over for Brady, the NFL preserves it's win in court. Both win. As it stands, either one could lose. Of course the NFLPA may not be too happy about taking the loss.

And the Pats are still docked two draft picks for a non-offense?

Maybe that isn't the top concern for Brady, but those picks need to be returned too.

That #1 this year could have been used to protect Brady's blind side.

Greenberg is a mouthpiece. The NFL is posturing to control expectations ... If we lose well we knew it was coming ... If en banc is not granted another victory lap. Meanwhile, Ivan nailed it. My guess s that sometime after Kraft agreed to the team penalties and the Goebbels Goodell's ruling someone got the idea that if the league could frame Brady (not a sympathetic player ... Outside of New England ... The perfect ffor this then the NFLPA would be backed up against a wall to give up anything the league wanted.
 
I don't know. I simply read that he was the judge who granted it. I suppose it's possible that he was simply the messenger. Not sure.

How is Brady filing a suit, getting his reps from Uggs and Under Armour on the stand explaining why they are a releasing a cheater/liar/perjurer like Brady, and how it will affect his finances, showing financial harm to Brady, while showing Goodell and Co's phones and computers, to show intent of a framejob here, "unwinnable"?

It's not only winnable, it's a slam dunk if you have been paying attention. I also think Ted Wells would actually testify on behalf of Brady because it's clear his investigation was compromised. i don't think he's too happy about some of the things Jeff Pash did, including his infamous "wordsmithing".

The 56 proven lies in the Wells Report are already proven, so once a judge opens up the case and get to the discovery portion of the process, on ALL of their phones, including starting with John Harbaugh and Chuck Pagano, it's a slam dunk.

We all now how this unfolded, dude. And right now, Goodell has called Brady a cheater, liar and someone who lied under oath, and Brady would have plenty of money to rattle the cage of the NFL.

But, John Harbaugh can start on that stand and tell the court what he and Pagano talked about AFTER Brady told Harbaugh to "check the rule book".

The last thing Goodell wants to do is take a federal stand, explaining his emails and texts on an overhead projector.

Brady disposed of the single item with the greatest bearing on the truth of the NFL's statements and he is going to get a court to order discovery on the NFL? Get real. Never mind the lack of damages, which you circumvent above by creating an alternative universe where Brady is dropped by sponsors.

The whole thing is patently absurd. The Wells Report is a product of Paul Weiss, not the NFL, and, irrespective of that, doesn't contain a single lie that could form the basis of a defamation suit. Goodell's ruling is the opinion of an arbitrator. When an arbitrator issues a ruling the losing party doesn't like, they can sue the arbitrator for defamation? That's not the way it works. By the nature of the job, arbitrators, judges, whatever, interpret the facts in a way and reach conclusions that one party doesn't like, and often sees as extremely unjust. That does not make it actionable. This is all silly but if you want to believe it will happen go right ahead.

For those not familiar with it, Brown tested positive for a PED and the NFLPA proved that it came from beff in Mexcio:

Clenbuterol has been used to control asthma and as an unregulated weight-loss supplement. It is not used in any medication approved by the Food and Drug Administration and is banned by the NFL.

Florio rightly points out that a neutral arbitrator heard the appeal and ruled from Brown and if it was heir Commishiner he would have sacked Brown for ten games.

Bottomline, the NFLPA needs to remove Goodell as the arbitrator and should do whatever they can to accomplish this.

And you forgot an extra first-round draft pick in 2017 for the Patriots.
 
A President can only pardon for Federal offenses but there is no love lost between Trump and the NFL ( remember the USFL) and he could make life very miserable for the league........in a host of ways...

And what would you consider "integrity of the game"?

The single greatest item bearing on the truth in this matter is the science, not Bradys phone, which the league got complete access to the records from it. And as far as Bradys value goes he dropped 2,000 places in the rankings of celebrity value for advertising according to a Globe article last year. Brady has a strong defamation suit the only question is whether or not he wants to spend the rest of his career in court
 
Take this for what it's worth, which is likely not much: Greenberg on Mike and Mike made an NFL prediction, among others, yesterday that Brady would play all 16 regular season games this season. A few minutes ago he elaborated, saying that legal people have told him that the Brady case is far from over and that the granting of an en banc was more likely than not and likely to happen. He cited Chin's granting of the 14 day extension as the first evidence that it'll likely happen. This is so different from what I've heard from McCann and others that I wonder where the truth lies. I'm strongly inclined to defer to McCann et al, but I like Greenberg's take better. Just interesting, particularly coming from that clown and his show.
I dont think greenberg knows anything.
 
The most ironic thing in all this is that by fighting tooth and nail to protect Article 46, the NFL has pretty much made sure that the PA will put removing that article from the next CBA one of their highest priorities.
 
How? I can see Congress making life miserable for the NFL, but what could a President do in the pursuit of his/her normal course of duties?

Other than just comment on it randomly, which would be embarrassing to the NFL but hardly cause a dip in their financial momentum and fortunes.

President Trump could stack the NLRB (National Labor Relations Board) with his people and order them to go after the NFL, that would cause a major headache. This is only one of a thousand things a President could do.

Imagine the PR nightmare for Goodell if next March, in the Rose Garden, President Trump greets the five time Superbowl Champion Patriots and spends his entire time, roasting Goodell and proclaiming Brady's innocence and greatness.

The President can only pardon for Federal criminal offenses,, not civil matters. However, a President could make life very miserable for an organization by siccing all sorts of Fed agencies on the league.
*DEA- checks team physicians to see that controlled pain meds are properly dispensed.
*EPA- are the stadiums dumping anything?
*OCR- are there any sex discrimination cases?
*IRS "random audits" of high level team personnel
*OSHA- 'random' audit to check workplace safety...
*DOJ- let's reevaluate that anti-trust exemption
While some are blatantly illegal like using IRS for political means, I can envision a certain candidate for President who is friends with TB making life very uncomfortable for the suits at 345 Park ave. When it starts affecting the owners' bottom line, you will see how fast Goodell gets reined in...
