I commented on your post. You went personal. No surprise there, given what you normally do, but the post of yours that I quoted was still not accurate, and all the personal attacks in the world aren't going to change that.

I don't know you personally. I replied to your know-it-all comment of NO which is the kind of arrogant response that posters no here have noted from you.

Never Know What Resonates With Judges. Before an argument, it is difficult to predict what particular arguments will resonate with judges. Though the guilt-innocence facts of Deflategate weren’t directly at issue in appeal, they are relevant to part of the arguments. It was surprising to see how much focus the judges gave on the facts, and how much they seemingly revealed about their views of them.
 
If he is suspended, I believe there will be a union walkout. I honestly feel this.. as far as the Union is concerned is going to be the straw that breaks the camels back.
 
If he had probed Kessler with something along the lines of "well the balls being deflated does seem a bit suspicious don't you think" then I could kind of understand that. He may very well be skeptical about Brady being totally innocent even with all of the new evidence and stuff. But to outright declare that the evidence is convincing if not overwhelming... my head hurts.
Just goes to show that even a law degree can't fix stupid.

Not a chance the union rank and file is going to risk their careers for Pretty Boy Brady and the hated Pats.

But the next time the CBA is up for ratification? There's 0% chance of the union not striking at that point.
 
It's more a rational thought than anything.

Everyone's saying Kessler got destroyed, yet everything I'm reading regarding the questions asked by the Judges, have nothing to do with Berman's ruling, of which is what actually is being appealed, so it's confusing to say the least.

It may simply be a case of the judges having a little too much fun with this. As long as the decision goes the right way, whatever.:rolleyes:
 
Can anyone help me understand why Kessler was LA and not the other partner from W&S that has appellate and SCOTUS experience?

losing a 1st rounder is horrible now theres a pretty good chance tb12 will be suspended over nothing....

That's not particularly surprising. Lots of lawyers have gotten their asses kicked by Clement. Clement is a high-powered appellate (esp SCOTUS) lawyer. Cream of the cream. Stuff like this is literally his entire job and he's pretty much unanimously regarded as being really, really good at it.

I'm actually surprised Kessler did the orals and thought so from the moment I heard it would be Kessler arguing today and not Johnson. The skill sets for appellate and trial appearances are rather different.
 
Appeals to the Supreme Court? That's the court after this.

You want the Supreme Court to weigh in on deflated footballs?


Berman will judge on things he previously.hadn't and we're back to step one.

Also, yes, I do want it to goto supreme Court.

It won't be over footballs though, but about notice and Wether or not Goodell can legally even do the things he wants to.
 
This ends in the CA2. It will never get to the Supreme Court, no matter who wins or loses.

Like I said, Berman had multiple things left to judge on once the current process is done.

Brady misses 0 games this upcoming season but frankly if this is gonna drag out 4 years he might as well settle cause this can't be good for his mental health.

That, in a nutshell, is a large part of why this is so absurd. How can one player be penalized when the other isn't? #Integrity

This feels like the NFL is trolling everyone here. One of the superstar lawyers they brought in for this appeal states in court that Aaron Rodgers committed he same type of equipment violation that Goodell feels is worthy of a 4 game suspension. As far as we know, though, the league didn't even look into that.
 
I'm not jumping off any bridges, and not just because of the unimportance of all this in a year when Donald Trump is a serious possibility to become President of the United States.

Rather -- let's recall that Berman shot down the NFL on several different grounds. Only one of them has to hold up on appeal for Brady to remain the winner.

Unfortunately, the appellate judges don't have to send it back to Berman. They can. But they don't have to.

There should be a fan walkout as well.
 
I just can't get past the whole "evidence is compelling if not overwhelming". It's one thing to defend the NFL on the basis of the CBA and what it may or may not allow Goodell to do. I get that, there's a lot of nuance with it. But FFS, over the last 8 months we have seen article after article and study after study that shows that not only was the Wells Report incredibly flawed in both its methods and assumptions but that its overall conclusion was in fact, more likely than not, incorrect. Where the **** has this judge been that he thinks that the evidence is overwhelming after all of that, ESPECIALLY when in the NFL's own investigative report their conclusion only went as far as saying that Brady was probably generally aware. What the FUUCK

Such is the state of science education in 21st Century 'Merica.

And with the Hildebeast's email situation getting more thorny, it's looking more like PROBABLY for Trump.

I suppose you have to try to have some faith that reason will prevail notwithstanding Chin and BDP's buffoonery today.:rolleyes:

That's simply not accurate, and Stradley did not say that it was.
