Proper notice of punishment for violations, ability to cross examine Jeffrey Pash, and lack of consistency in punishment for similar violations.

It could be the judges decide to split the baby and overturn some of the rulings, but not all.
Not sure how any rational person could argue any of those. At LEAST the second one. We have easy proof of that.
 
Good thing Chin isn't Polish or the Archie Bunkers would all be coming out of the woodwork.:D

Let's simply hope that Chin's crazy ass remark was a misquote or the judge's clumsy way of wanting to appear "tough" on both sides.
 
no need to get dander up...blah blah.......it goes back to a near original point in the proceeding .... Parker questioning whether ball inflation provides an advantage.

I think that based along those lines, the argument does not get past the fact that there is no evidence that ball inflation is an advantage.

Who were the idiots that said they would not be arguing this ****?
I guess arguing that some actual wrongdoing be a condition precedent to punishment was too "layman" an argument for some.

The fact that Wallach and McCann (who were there) seem confident that Chin will rule for the NFL is worrisome. If they think it's going to be 2-1 against Brady, then I'm not at all optimistic.
 
Hurley doesn't sound very optimistic about how things went today. Oh well....

i hope that's a typical MCI misquote or repetition of what he thought he heard someone else say he thought he heard Kessler say, because if he said that, Kessler lost his cool and that's usually a mistake with Federal Judges. I was surprised that Kessler took the lead today and not Johnson, the Appellate lawyer.

this sounds bad..

kessler got his ass kicked. judges showing that they will rule for the nfl, similar how berman did the same for brady. i don't think theyre playing " devils advocate "

I hope I don't get drowned with PC backlash, but it's just a joke. In reference to, if anything, the complimentary stereotype of asians being super smart. Chin must be an anomaly if he truly thinks what he does.

I'm not a lawyer but that seems to me to not be a wise thing to say to 3 federal judges.

On the same level not like hes Johnnie Cochran up there calling everyone and their mother a bigot....

It goes back to Berman in some form

Not necessarily. If the panel reverses Berman it can go two ways:
  • Only reverse Berman on the things he explicitly considered and remand back to him to decide the things the NFLPA brought up but he didn't consider the first time around.
  • Reverse Berman on the things he explicitly considered, find for the NFL on the things he didn't explicitly consider, and end the case without sending it back to Berman.
