I am unfortunately a bit pessimistic. Everything tells me it should be overturned and the suspension lifted BUT as Darryl wrote, nothing about this case has gone the way it should. Granted, that is because it was in the hands of cabal at 345 Park Ave (no disrespect intended to other cabals)and now it in the hands of a Federal judge but the bar to overturn a collectively bargained arbitration award is extremely high.. Did the NFLPA, Kessler and Brady meet it? I hope so, I think they did but Federal judges with lifetime appointments march to the beat of their own drummers.....especially one in NY....

Well said nothing has gone as expected in this case, so why is this different?? An impartial forum I hope.. but courts and judges are quirky..
 
As much as I agree with the article and believe it will all be dropped, remember when most of us thought the the Wells Report would exonerate Brady.. then we all believed that the suspension would be reduced when Brady Appealed to Goodell.

Courts/legal systems can be quite fickle... I am in the camp called "guarded optimism"...

The Wells report did exonerate Brady. That's the best part.

Ben Volin is a reporter, right? Isn't it his job to find out why Dowd has created a deflategate site? :mad:
 
I think Dowd sees an injustice and wants to expose it. I heard him interviewed and he's flabbergasted why they would do this to one of the game's best players, great ambassador to the game. To what end he asks, it just doesn't make any sense. Of course we know its a grudge from those in power in the front office, I would be very surprised if Berman can't see right through this, the question is does he have enough to overturn legally.

That is such a Volin response. But why? Because unlike MCI, some people actually care about the truth. Because they get the point of media, and they aren't lazy clickbait ******** peddlers.

It's also horrendously irresponsible for a "reporter" to talk like that. Here, let me try:

I sure hope that Ben Volin isn't a child molester. I wonder if a detailed investigation would uncover that Ben Volin is a child molester. Do we have any evidence that Ben Volin isn't a child molester? I would really hate it if the public came to associate Ben Volin with child molesting because people like me keep typing stuff like this. I bear no responsibility in this, though, because I'm just posing baseless, hypothetical questions that have no reason to be written down in the first place.

Don't know if there might be any connection with his former employer, but it's an interesting point. On the one hand, Akin Gump is an international law firm employing almost a thousand lawyers, so it's a really big firm. Dowd was in their DC office, their corporate headquarters, not NY, where the NFL is headquartered, so he seems unlikely to have been a part of the NFL legal team. OTOH Dowd is a really top talent, he might have been pulled in for consultations on a high profile case like this one. Given that he seems to be a straight shooter he might've chosen to retire rather than being obligated to act as counsel to evil doers. No way to know, but interesting to speculate.
 
Not sure what the obsession is with this Volin character - he is a lop playing the bad cop role for his publication. He'll make himself look bad, make a name for himself doing it, get clicks and find his paying niche. However, he is right about one thing, it would be unfortunate if Kraft was even in part behind the website. It just makes Kraft/the anti Goodell crowd look as underhanded and scummy as Goodell. Our side is not going to win this fighting Goodell on the scum level. Goodell and his scummy minions are in their sweet spot in that arena. We can win, hopefully, by sticking to the truth and repeating it over and over.

I would be shocked if Kraft is behind it. IMHO this is about Dowd and a few others seeing an opportunity here. Nearly everyone was behind Goodell and his crusade of righteousness. Media wanted Brady dangling at the end of a rope (figuratively) and didn't stop to look at it comprehensively, precious few stopped to look at and report the glaring inconsistencies of Goodell/the facts. So you can be one voice drowned out in a sea of hundreds of lemmings, or be one voice in a group of two or three that could look pristine IF this case comes crumbling down around Goodell. This is an opportunity for Down and others like him (steph). And when one looks at the weakness of Goodell's actions/case, this kind of opportunity is uncommon. Normally powerful scummy entities like Goodell's office usually make sure their underlying case is stronger before acting like the hitler youth to railroad someone. It appears to me, albeit I am biased, Goodell has hitched his scummy trailer to a weak hitch and tangibly exposed himself to a smackdown. This is an opening for these few voices of reason to look real real good in front of the sea of glib lemmings.

And it makes sense since there are some similarities between the two investigations. He seemed shocked at the ineptitude of the NFL investigation. Could be that after the spate of radio interviews he realized he could make a lucrative retirement income doing investigations and is setting himself up for that.
